Sudan’s Constitutional Court turns down ban of SPLM-DC

January 17, 2009 (KHARTOUM) – The Sudanese Constitutional Court ruled today that the semi autonomous government in Juba cannot ban the political activities of the Sudan People’s Liberation Movement-Democratic Change.

The Splinter SPLM-DC has been prohibit by the First Vice President Salva Kiir Mayadrit when he directed as President of southern Sudan government, on November 9 to not hinder the activities of the political parties "except the so called SPLM-DC"

The SPLM-DC leader Dr. Lam Akol said this presidential decision violates the fundamental rights of his party granted by the interim constitution of 2005.

"This letter is incompatible with articles 29, 31, 33, 40 of the Transitional Constitution" dealing with fundamental rights, akol said following the ban, adding that the SPLM-DC is demanding the constitutional court to declare null and void the contested decision because of its unconstitutionality.

The Southern Sudan ruling party, SPLM, said Akol’s party is an armed movement causing unrest in the region.

The former foreign minister is nominated by an alliance of southern political parties for President of South Sudan, where he will run against SPLM chairman Salva Kiir Mayadrit.

"This is a victory for constitutionality," Akol said of the court ruling.

The southern Sudan ruling party, SPLM, is accused by opposition parties and the National Congress Party of intimidating and arresting their membership as well as hindering their political work.

      Dr. Advisor,

It is sounded wonderful in your narrow thinking but still Dr. Lam will remain ban with his party in the South because he is sneak in the green grass.
Too, per Dr. claimed that his political right has been denied, he has also sold the rights of Southerners to the Notherners, therefore treat the fire with the fire.

That is Lam Akol who is a candidate for south Sudan presidency is saying on sudanile.com the Arabic website. That the decision of accepting referendum bill is wrong, he continued that separation as the suicide for south Sudan ever. Therefore, if he is saying that what will happen when he is a president for a south, he will cancel the CPA and that what Lam Akol is looking for, because he lost his Fashoda agreement due he is jealous for CPA success.

Although, Dr. Akol might not have enough supporters to boost up his candidacy for Presidency of the South. I’m thinking that in few months to come, he should be able to gain an adequate popularity among Southerns because Mr. Salva along with his comrades are not doing what they supposed to be doing. Therefore, chances are Dr. Akol would have enough time to specified his ground.

You guy can preached and preach evil spirit. But that will not harm the SPLM/A objection since from the start.SPLM/A is a tool to bring a demaratic society. It can not be demacratized right.Secondly, the so called sharia law it has been there since.Even if they allowed DC to exercised it political in the south, the CPA will still ruled it out.So you are a dead dreamer.Thank

Congratulations to SPLM-DC and Dr. Lam Akol for defeating 1st Lt. Gen., Salva Kiir, in the Court of Law. Now the time for another victory is approaching when Dr. Lam who is now the candidate of the Alliance of South Sudan Politcal Parties for GoSS Presidency shall defeat the SPLM in the ballot boxes.

The bullets shall not count any more and whoever thinks he can force people’s confidence by threat of bullets rather than gaining their confidence by ballots is going to regret his politcal foolishness.

Kiir has dug his own grave and he is now falling into its heat forever. Let him grind his teeth and bite his fingers for the defeat. Gone is the era of totalitarianism and military dictatorship in civilian affairs.

Long live the Constitutional law, long live the savvy politicians who respect the rule of law and long Live the power of the people through democratic elections!!!

It does not matter what the constitutional court verdict is. What matters is whether Southerners have a stomach to listen to a traitors and a political prostitute like Lam. He is in for a rude shock if he really thinks he can win in the South.

      Mr. James Okuk,

Yes, the so-called constitutional court has favored your party, but don’t forget that it’s an Arab court. Lam knows them well for what they did to his FASHODA PEACE AGREEMENT. Do you think the rule is a victory to Lam? No, far from it. It’s a victory to turn southerners against each other under the pretext of freedom- which is," kill a slave with a slave in the Arab mindset", although we are not slaves to them.
No Southerner has an interest in the party which was formed in Khartoum with the Arab enemy funds.
SPLM/A has never used bullets against innocent Southerners, but history knows the real killers and culprits who have inflicted so much damage and setback to us than the Arabs.

Despite my respect to Dr Lam Akol, i think he is a visionless leader and lack critical thinking, because no matter how much you think you want to be a leader, you cannot jeopardise the security and stability of your country, Lam akol is a greedy leader only after money and power, he is not here to serve the people, shame on you Lam akol, you fail to understand the proper route to leadership.
