EU envoy calls for independent judiciary in S. Sudan

March 7, 2012 (JUBA) – A European Union (EU) envoy has called for an independent judiciary in South Sudan, describing it as a “cornerstone” for the rule of law and respect for fundamental human rights in the new nation.

While at speaking at Wednesday’s launch of a project financed by the EU in support of South Sudan’s judicial sector, Sven Kuhn von Burgsdorf, said the young nation remains at “critical juncture” and requires an independent judiciary in the wake of its current financial woes.

"South Sudan is at a critical juncture. It is now more important than ever to maintain our support to the development and capacity building in core government functions", said the EU ambassador.

He pledged the EU’s continued support South Sudan’s judiciary, with specific focus on improving access to and delivery of justice, in light of the country’s current financial situation.

Justice Chan Reec Madut, South Sudan’s Chief Justice lauded the EU’s support, saying the project will assist in training judges and other judicial support staffs.

Acknowledging the numerous challenges the judiciary still faces, Madut said efforts are on course to address existing problems, citing a recent move by the judiciary to establish mobile courts in all areas that lack judges.

Also underway, the Chief Justice stressed, is the Judiciary’s commitment to the establishment of a judicial training institute in South Sudan, targeting both the new and existing judges in the country.

The project, which runs until 2014, came into effect because of strong ties between the International Development Law Organisation (IDLO), the EU and South Sudan’s judiciary.

Ted Hill, the IDLO Country Director, expressed optimism that the project, which has been designed based on the country’s own needs, will help the judiciary meet the challenges it faces, including the change from Arabic to the English language and the adoption of a common law model of justice.

Justice in South Sudan is also under threat from political influences, with the Governor of Lakes state banning human rights officials, lawyers and family members visiting young men arrested on suspicion of involvement in banditry and inter-clan violence.

NEPOTISM PRACTICES

South Sudan’s judiciary was recently in the spotlight after the appointment of the Chief Justice’s daughter, as one of the country’s 78 legal assistants, attracted lots of criticisms from the public.

In the eight years since South Sudan gained self-rule, the ministry of justice has not prosecuted a single official for corruption despite billions of dollars having gone missing from the state treasury. The revelation about Justice Madut’s daughter has reinforced the perception among many South Sudanese that the current regime is both corrupt and nepotistic.

    hahahaha.
    EU which judiciary?Judiciary of s.sudan.those re SPLM members. They re not nuetral.some re even were public adm. Especially unity state they were appointed as atorney in the judiciary system.
    I bet them,they re not qualify judge but gangs of corruptionist.

      Julia,
      The irony is that even those who are well trained in judicial matters, those not members of the SPLM are equally tribal and nepotistc. What is important is that South Sudan judiciary establishment needs a thorough overhauling over wide range of issues, including effecient and effective use of English lanaguage. At present, most of our judges are linguistically handicapped. It’s pathetic!

        In those court run by Arab brought up judge,when u begin to present ur case in English,bro make sure that is the first sign of lossing ur case.they term it as the direct challenge to them from u. Not putting in mind that English is the official Language to be use the public instituation in s.sudan.
        Bro we re in trouble.

    we don’t have independent judiciary here in south sudan,the current judiciary is fil with corrupt Bhar el Gazel warabians with the aim to protect their extra-judicial doings.mr Chan Reech Madut was hand pick by kiir’s to defence their interests.it could be consider a waste of resource of EU to fund such a ill corrupt institution.

      I suspect the relative use of corruption in some circles. In South Sudan or elsewhere in Sudan this word is used selectively if a person in charge is not from our community, clan or party. Where are we leading if a person running national affairs belonging to our camp is not criticised though practically corrupt and ineffecient he conducts himself/herself?

      no one devoted me from unity state!only fact matter to me alot.
      That why i jioned SPLA in 1984 to fight nepotism,corruption, torturing/detaintion of citizens without fair trail as it is going on here in Juba.where the poor re ruin in the court of law in favour of the rich guilty culprit. Eg what happen to Arthur the judge was the first to say SPLM oyee! We worn the case.after declearing.

    "CORRUPT AND NEPOTISTIC", is the correct description of oyee party. This man chan Reech wala rach has done something shameful to his family by appoint his own daughter while there are more qualified judges who are more senior to her and they are there without jobs. what a country!!!!!!

    Working in Government position is not permanent jobs. They will be change in any time and somebody will go in. I see some of our people think if they working in Government jobs position they will staying there for their life.
    We shall see that in election. Let those countries want to help South Sudan help South Sudan.
