Constitutional land rights in South Sudan "misinterpreted", E. Equatoria governor

February 24, 2013 (JUBA) – The Governor of South Sudan’s Eastern Equatoria State, Luis Lobong Lojore, said on Sunday that the liberty of civilians to “choose residence” anywhere in the country has been taken out of context by some groups.

Governor Lojore made the remarks at a public meeting in Nimule, where tension is rising following the national government’s orders to demolish shops and restaurants.

“The problem is the misinterpretation of the [South Sudan transitional] constitution,” Lojore said. Article 27 (1) says: “Every citizen shall have the right to freedom of movement and the liberty to choose his or her residence except for reasons of public health and safety as shall be regulated by law.”

Governor Lojore was responding to a petition presented by the Madi community, a tribe that traditionally inhibits Nimule, a South Sudan town bordering Uganda, 190 km southeast of the capital Juba.

A youth leader read a letter from the Madi community to the Governor outlining their concerns, which included; land grabbing; destruction of crops by cattle belonging to the people from neighbouring Jonglei state; parallel traditional courts for indigenous and other South Sudanese; harassment of local people by groups of Internal Displaced Persons (IDPs); and encroachment into South Sudanese territory by the Ugandan government.

Preferring to respond to the petition rather than making his prepared speech, Governor Lojore said land grabbing is unacceptable under international law. The governor also ordered cattle owners from Jonglei state to restrain their animals.

“I am a cattle keeper but I know cattle and crops do not mix,” said Lojore, receiving thunderous ululations from his audiences.

DEMOLITION OF SHOPS AND RESTAURANTS

Last week, South Sudan’s ministry of interior gave a 21-day ultimatum to owners of shops and restaurants constructed within the area demarcated for new migration and customs offices to be built.

Survey officials marked with red ink the business buildings that will be destroyed.

Owners allege that the process is not genuine and is related to competition over the lucrative trade center between the Madi, who own the town, and other South Sudanese.

Under South Sudan’s laws, land belongs to the local community. Article 170 (1) says: “All land in South Sudan is owned by the people of South Sudan and its usage shall be regulated by the government in accordance with the provisions of this Constitution and the law.”

Article 171 (2) categorises the land into public, community and private land. And article 171 (5) defines community as “all lands traditionally and historically held or used by local communities or their members. They shall be defined, held, managed and protected by law.”

South Sudanese from other states moved to Nimule, in Eastern Equatoria
state during the 1983—2005 Sudanese civil war and have never returned to their ancestral land. Wounded soldiers and their families; not natives of Nimule, have also stayed on in Nimule.

Issues of land rights are sensitive in South Sudan, with tribal feuds often blamed of on land ownership. Politicians often use land wrangles to consolidate political dominance.

        If the governor says “Constitutional Land right” has been misinterpreted; then what’s his correct interpretation? He can’t just say land grabbing is unacceptable under international law.     I remember long time ago when i was a kid in a small town in western Uganda we woke up one morning and saw some strange looking people in front of our house, they almost looked like extraterestial beings from another planet. I asked my dad who are these people? he said they are you people, I said what do you mean my people? he said they are Dinka from Sudan, I didn’t like them at all... not one bit, they followed us like dogs everywhere, to school, shopping, I mean everywhere we went they were following us... our lives became a living nightmare. We later learnt they walked all the way from Bor to western Uganda without and map or a GPS guidance system, to this day i have no idea how they managed to located us.

      As a researcher in South Sudanese indigenous languages, I would like to make some points as regards the word " jenge". It does not mean nakedness. It is the development of word "jang" which to dinkas means pples, public or dinka tribesmen or "muony-jang". It is a tribe name and one of the leading scholar of our team who is a dinka proudly introduces himself as "jenge"

        We also found that nakedness was not applicable to a single tribe in Africa, let alone South Sudan. All tribes in South Sudan used to go naked except in few cases where animal skin were used. The word jenge is a matter of phonetics. You need to expand your brain rather than restricting it to baseless arguments, now if we ask, by which/whose tongue is the word "jenge", u can’t tell us.

      The anti-Dinka sentiment is growing so fast across South Sudan, though not all dinkas are bad, unfortunately every bad thing in the country is done by Dinka. It is important that you think and revise your attitude towards other tribes who have equal right in South Sudan or else end up regretting.

    Why did you the jenge people alow and fail to libarate abyei and other areas grabbed by Arab nomads?
    Most of the jenge and nuer were slaves of arabs and muslims and now arabs call them fake muslims.

    I am one of the happiest people who jubilated the death and Helicopter crash of John Garang. Its good he died and GOD eliminated him from the face of South Sudan because he is responsible for the tribalism spreading in South Sudan. Dinkas are the most ugly set of people in the whole world and they know it. They are claim to be elites but thats not true. Barbarism is what they are good at. Period
