Supreme Court rejects NISS challenge against Sudanese newspaper

September 2, 2012 (KHARTOUM) – Sudan’s Supreme Court rejected for the second time a challenge by the country’s National Intelligence and Security Services (NISS) against a daily newspaper that published a story about the rape of a female student by NISS officers last year.

Al-Jareeda newspaper reported at the time on the alleged rape of the 25-years old Safia Ishaq by NISS agents, which followed her arrest in Khartoum after an anti-government student protest.

A Sudanese court ruled against the newspaper ordering it to pay 5,000 pounds and also penalized a female reporter 2,000 pounds in a defamation case initiated by the NISS after the publication of a story about the rape for reporting a false story.

The appeals court upheld the ruling.

The lawyers of the newspaper appealed the decision before the Supreme Court which overturned the sentence in December 2011.

However the NISS asked again the Supreme Court to review the case invoking its jurisdiction in substantial matters to interpret the law.

The security apparatus argued that the press law provides that newspapers must perform due diligence and verify the news before it is published. The NISS stressed that this did not take place thus violating article 66 of the press law.

The highest court in a decision issued on August 22nd, seen by Sudan Tribune, reaffirmed the previous ruling rejecting the NISS appeal .

The Court said article 66 (defamation case) can only be enforced when there is a dealing with false news, and it is proven that the newspaper deliberately published a story despite it being bogus.

Further, the five-member chamber stipulated that the publication of the false news story must be done without comment.

In this decision, the Court appeared to be moving to ensure a large margin of freedom for the press as it says a false news can be incriminated and seen as a defamation when the bad faith of the newspaper is proven.

Safia has left Sudan and moved abroad after marking her name down as the first woman to publicly accuse government officers of rape.

    the so called NISS is an evil spirited organisation thirsting for the blood of the inocents sudanese, therefore this indicate that there is a dim light in the tunnel in Sudanese society.
    better late than never always. this was long over due. bravo bravo bravo high! Atleast you start to show that you are not just a white elephant structure go ahead!!!

    That what we are looking for, true independent judiciary system that is not influenced by the government, this verdict from supreme court proves our judiciary system is faithful and valid.
    I condemned Khartoum government for confiscating three newspapers yesterday:Alsahafa, Aljareeda & Akhirlahza without giving any explanation, government should understand clearly

      that the time of confiscating media and terrorizing journalist is over, it’s time for real democracy, Sudanese people will not satisfy unless we have a full democracy like the rest of our Arab brothers countries, Al-Bashir & Ali Osman should retire and open the door for new youth who deeply believe in democracy and other opinion to lead otherwise expect the flood!

    What if the rape by NISS officers to this female student turns to be correct?
    This is really very dangerous accusation and if proven then it will really be a big a scandal to our government which always claims to be implementing Sharia and their officers are well disciplined and very ethical!
    The head of NISS should resign immediately

      if he doesn’t then should be fired, the perpetrator NISS officers should be brought to justice and punish,NISS should be reviewed and its law should be changed and toughened to prevent it from happening again,our government should apologize to this young lady and does what ever possible to restore her dignity back and recover her pain!

    the maxims of NIF is from the thrown to the grave.
    suggesting they may be change with a ’younger blood’ and new ’democracy’ which is not found in their dictionaries is a sort of neo-sucide man! wait if you will not follow the 3 news papers in there

    I surprise to hear that news of rapping carried out by NISS against their Arab lady. The Supreme court should tought alesson to those NISS. n Bashir should not forget that his NISS are criminalized his govnt u just allow the law to act against them to face life sentences in custody.

    this is nonsense, what happens is happen and this verdict is not stipulating further probe in the case to prove it right or wrong, or redress grievances..
    it’s quite clear that NISS is taking over the country doing whatever suits it and anyone lift a finger will be punished by hook (court of law plays) or by crook (detained raped torture, etc)..
    no one knows what’s going to happen to his daughter

      monitoring is the only way to prevent any one from abusing his power, and totalitarianism can’t tolerate monitoring for it’s a quite costly, that’s why it restricts its freedom and abridging the whole story in such plays of adjudication of arbitrary laws that has no constitutional ground
