Kiir will not step down as army chief if nominated for presidential election

January 14, 2010 (JUBA) – An official of the semi-autonomous Southern Sudan has ruled out any possibility of General Salva Kiir Mayardit stepping down from the army even if he is nominated as SPLM candidate for presidency.

Kiir is currently an active army General in the Sudan People’s Liberation Army (SPLA) and heads the recently formed military Command Council, composed of more than 40 senior SPLA officers, and also he is the Commander-in-Chief of the army by his being the President of the Government of Southern Sudan (GoSS).

The minister for Presidential Affairs, Dr. Luka Biong Deng, who is a close aide to Kiir on Wednesday, said Kiir’s candidacy would not need him to step down as commander-in-chief.

Dr. Biong argued that the Interim Constitution of Southern Sudan, 2005, stipulates that the President of the Government of Southern Sudan (GoSS) shall be the Commander-in-Chief of the Sudan People’s Liberation Army and if Kiir was nominated for GoSS presidency he would not step down as Commander-in-Chief.

He however admitted that presently the SPLA Act states that no member of the SPLA can participate in political activities but said there will be decisions made within the regulations of southern Sudan.

Biong however did not further explain whether Kiir would still wear military uniform with his active rank as General in the army or be stripped of the military uniform and contest like a civilian if nominated.

The Sudan’s national Interim Constitution, 2005, requires aspirant candidates, who serve in the army, civil service and as judges, to first resign from their professions before their candidatures are approved by law and allow them to run for political positions.

The Southern Sudan interim constitution is however silent about what the aspirant candidates for political positions, while actively serving in the army, should comply with during elections.

There was no body available for comment in the government’s legal institution to explain the implications of the Sudan’s national interim constitution and the national elections law over the Southern Sudan interim constitution when dealing with issues of national competence such as the elections.

During the GoSS formation in 2005, all the draft constitutions of the ten Southern Sudan states including the Southern Sudan Interim Constitution had to be taken to Khartoum for approval by the national legal body to make sure that they were compatible with the Sudan’s national interim constitution, 2005, pending their final enactment by the respective parliaments in the South.

Questions in the minds of many people that are left to the legal experts to answer include which law (national and Southern Sudan) is supreme over the other when it comes to the national issues such as the elections, or whether the National Elections Act only partially applies to the South and leaves the electoral process of Southern Sudan presidency to the constitution of the South.

It also remains to be clear whether the National Elections Act, 2008, which requires that a candidate first steps down from the army, in order to run for the elections, can equally apply to both national and Southern Sudan candidates at all levels.

Currently, Southern Sudan High Elections Committee based in Juba, which is a branch of the National Elections Commission in Khartoum, also requires that all civil servants, judges and those serving in the army in Southern Sudan and aspire to run for political positions should first resign from their incumbent professions if finally nominated as candidates.

The SPLM Political Bureau is expected in the next few days to declare party candidates across Sudan including its presidential candidates for national and Southern Sudan.

There are, however, statements indicating a process for possible alliance with the National Congress Party (NCP) which may lead to SPLM endorsing the NCP’s candidate, the incumbent President Omer Al-Bashir as sole candidate for national presidency.

Bashir on Monday stepped down as chief of Sudan Armed Forces (SAF) in compliance with the requirements of the National Elections Law, 2008, and the Interim Constitution of Sudan, 2005.

    Keep salivating hoping that you are close to your dream. You are chasing ghosts and will soon come a sad realisation. There is no way Kiir would relinquish his army post to a guy who sold Nuer land to arab oil grabbers. It will not happen.

    And you still have to have >10 years to prove your patriotism. Unfortunately, you are now doing more to show South that you hate South’s security by causing insecurity in a number of states.

            Dear readers,

            There are three issues about Kiir’s future leadership:

            1/ Will the political bureau nominate Kiir for South Sudan presidency? Does he deserve another 5 years of corruption, tribalism and isecurity with lack of vision and development?

            2/ Will Kiir continue being an army officer (soldier)and also being the Commander-in-Chief of SPLA during the elections despite South Sudan interim constitution prohibiting it? The constitution doesn’t allow Kiir to be Commander-in-Chief during elections campaigns and voting period. He can only resume being the commander-in-Chief of SPLA after he wins the elections and sworn in as democratically elected president.

            3/ Can NEC accept Kiir’s candidacy given this and some other issues that would disqualify him for presidency either in Khartoum or Juba?

              Dr. Riek never sold Nuer land to Arabs. Instead he brought back the Abyei land which the Dinka sold to Arabs. He went to Hague to bring Abyei back which was sold in 1905 by the Dinka Chief Deng Majok and his followers for food. No Nuer land was sold. And no Nuer kids were sold like your Dinka kids to Murle and Arabs. Okay???

Abyei was administratively transfered to south Kordufan by the Colonial Government , but the Arabs annexed it after independence geographically along with Central region, [Nuba Mountains] to the north. Was Gambella sold by Nuer? I don’t think so. An idiot blinded by tribalism can say,
                Yes! it was sold by Nuer.No.Gambella was sold by President Ibrahim Aboud. Lokichioko was sold to Kenya and Bazi to Congo.

      Back to the topic: there is nothing like that Luka, your boss must surrender his uniform so to abide by the SPLA regulations and laws. He must comply by those laws otherwise he could be taken to court.

      Second, the Interim Constitution for Southern Sudan isn’t in isolation and the NEC under Mulana Alier works under the National Constitution prescribes; a military can’t be in the civil contest without first resigned from the army.

      Who do you want to outwit political leech? It has been said repeatedly that you are source of crisis in Southern Sudan leadership, and one can now confirm. Don’t think you would get away with this again!

      Kiir must stay in the army with his uniform or go for Southern Presidency with military attires stored in Bilpam.

        I appreciate the suggestion of those ministers in regard to Kiir leadership, but we are not persuading millitary management in South Sudan. We are after democracy where things are challenged in the parliament, and votes will be the tool to make the final judgement. If Kiir is running for presidency it’s unquestionable that he will lost his GOSS or SPLA leadership after the outcomes which is general election. This is the only strategy of exposing our staring point of democracy. We are not children who shallowly book a seat in adavnce. Kiir has one chance, go for presidency or dessert behind.

        It is not that he was the only person created for that position, we have some individuals such as Dr Hero Riek, Polino Matip, Isaac Murmur, Igga, Thomas, and many more from dinkas side. I always yearn for exchanges that will show us some difference. Recruitment has to give everyone among the eligible leaders an opportunity. I disagree with this earlier declaration by some minsiters. This false judgement is the worse error that will weaken the motivation of Southerns, its unacceptable to reserve a place for someone with uncertain future. This is a clear signal of tribalism, because I can prove that all the whistle blowers of this idea are very specific individuals.

        Time to pull out of tribalism, we have to make South Sudan a nation far from the image of corruption and tribalism. Insecurity is not only our challeneg, but the rest of the nations are facing the same things in some ways. People must not act on behind of their tribe person like what I have suspected in this article. South Sudan is too behind an inch of development and self mangement just because of the existing attitude and unwanted culture. However its very easy and possible for us to eliminate this evil. We must united and fight the devil to its feet. Time is running and we still in the dark. My friend mind about the future of southerns.

        Time for tribalism has gone, 2010 is not a time to generalise tribe or community instead of one person. It is time to focus on the real issue far from tribal criticism, political party criticism, leaders criticism, and very far from abuses or insults. We should also debate far from abuses of any single commenter on ST forum, to myself I want to be a man of tolerance, peace, responsbility, respect, forgiveness, love, unity and courage .             You are predicting for the Death of a professional politician like Riek Machar, this will not happen at this stage. Don’t you know that God always protect peace maker like Riek who is ever mediating peace in Southern Sudan and Sudan.

            When SPLM’s official were arrested last month in Kharoum, Riek went there and settled the matter doplomatically compare to backing dog to in Yirol who is ever crying for peace but doesn’t know the procedues of attaining peace.

            Ladies and gentlement, I appreciate your suggestions. However it is 2010 which is year for starting real democracy in South, In democracy nations everyone has the chance to join the boat, as I did above. I embrace the people of Southern togther without criticism of being PHD holder or whatsoever. Whether nuer, dinkas, equatorians has them same chance of running the position. This is one of the best strategty that, I expect GOSS to adopt in order to bring the people of South together and feel welcome. Recogination, Promotion, Power and fair treatment are the keys for motivating Southerns and pulling South out of tribal management. We are not enemies in South, but we are been poorly govern and lead. All we see comes from the poorly management, Insecurity could have had its medication ages ago, but you know why we are still experience.

            Like above, You may isolate nuer, dinkas and equatorians, which means you are isolating some of your votes if you are a contestant. I stated sometimes ago that, fire goes with water this is what I expect right now from all my conern citizens. What had happened must be kept as history which is nothing but words and memory. Even if any of you could be running for presidency, I advise that you would admit even an arab man to come and contest as a governor in South. Because you want his votes and even the Southerns in their hearts knows who they are voting. Finnaly after victory you have the power to kick this arabs and put a right bolt. come on ladies and gentlement, think back to the time Nemerri used to overtake the whole South. His strategy was exactly like what I have shown above, Inteliigent leader embrace love against his enemy meanhile he keep his secrets to himself. Take South Africa as another hint.           Mr Famous Big_Logic_Boy I like your comment, but what you don’t know is that, SPLM was not a democratic party, but military wing. This light call CPA was achieved as a result of war between the SPLA and the Sudan government and as you see the war is not over yet. The Southerners people can argue that we have a qualify leaders with in the SPLM who can run the GOSS. Indeed, the suggestion sound excellent, but let us not kid ourself becuase we have seen since the beginning of the movemment, what type of leader we have in south. There is an old say that if you want to get there faster, row slowly. So if Dr. Riek Machar or any body want to be president in the South has to fellow the system and do what a leader can do. If everyone has been participating and pulling their weight, and if they do it in a manner that doesn’t compromise each other’s stroke, their progress will swift and predictable.If the Southerners want to choose a leader, is not gona be Dr. Riek Machar because he has not been forgiven for what he had done in 1991. We can go there and here, but that is not the case he knows.Positive leaders seek not to control, rather to inspiere. The best are not walled off by steep interfaces annd symbols of their own importance, but immersed insead in the culture and the people. To conclude,I don’t see Kiir stepping down as army chief soon because you can’t wait for the food to be cook and then you want to eat it, not good idea.

        Do you guys want to rewrite the Interim National Constitution of the Sudan(INCOS)? If yes,how? If no then follow it.

        For those who do not know what a constitution is, I better define it for you: It is the only "supreme law of the land".
        Is it called the Dinka Interim Constitution? Of coures not. Why are you barking loudly here?

        It is the same Interim national constitution which direct Kiir to do what is in it and not Kiir to direct the constitution. What is in that constitution must be follow the way it is because it is part of the CPA of which all of you want be immplemented fully.

        See this simple structure and study it carefully.

        3 Vice president

        4 Citizens

        See the whole structure and tell there world were Dinka is here. Constitution is for all of us no matter which part of Sudan, South Sudan you are from.

I always see comments made by other tribes to attack others. The most common ones being Dinka attaking Nuer, Equatorians, or Murle. I have never seen and I will not see/hear a country like South Sudan where tribalism is high. This is why S. Sudan is emerging to be the most corrupt and backward country in the world, TRIBALISM.

      Imagine what happened in Lakes state electoral college. The semi illiterate Chairman called man kuc just rigged the nomination in his devil heart. yesterday another crap and Ugly monkey like, called Mabor Kau another guy that was bribed talking rubbish that the selection creteria is based on what you have done/achieved in the movement.if that is the case, how can deserters and late comers to the movement scored highly, this is laughable. The Ugly Mabor mentioned that Paul Mayom Akec and William Ater drew, it was the semi illiterate chairman’s vote that remain to be cast, when he casted his vote, it altered all the 24 members votes by bringing the last person (Deserter or Nyagat by Name Magok Manyol) that got 3 votes out of 25 to be in the reserve list while the one of those who drew takes the third position votes. this is amazing and shameful to State SPLM Secretary Mathing Ker, who is suffering from Ma’ngurek in my dialect or (what shall i do, in direct translation) (that is cronic wound that does not heal no matter what. that is cancer of cours) I would like you guys to take bribes and do the right things than confusing the whole state by the filthy mouth of yours that do not know boundries of where and what to eat from whom. SPLM in Lake State is in a complete failure coming the April General election.
      Lakes State is the worse state in South Sudan in term of nomination where people with chicken brain are involved in Electoral College. The guys are bribed like hell, the worse part of it is the chairperson of the 25 people that make up the college, Mr Abraham Meen Kuc, is a beggar who have not attained certificate of any Educational level being a primary or high school. Philip Marol Mading and Mathing Ker are the crooks of all that will cause disaster in the state. I don’t understand why the Electrol College was formed in the first place if Abraham Meen Kuc, Mathiang Ker and Philip Marol Mading altered what 24 people came out with. Meen Kuc, when you are assigned to a national obligation, you need to be careful and do the right thing for the state and the country as a whole. you were not given the task in order to get rich over night of (V8 car)Miith Apuol, the luxurious car that will reached Rumbek today from Juba as a promise by Paul Mayom Akec and Deng Athorbei just to alter the original work of the committee in Palm Tree Hotel. Shame on Meen Kuc and Mathiang Ker

The leaderships we read in the book can not work alone without experiencing it practically, if you want to be a president, then you apply, if you passed you will never be better than them. Secondly Salva & other 14 SPLA top officers who met this week in Juba are not foolish nor they are from one tribe in Southern Sudan, so the decission they took is extremely brilliance & for all of us. I can remeber my last week comment on Bashir’s step down not to be taken as opportunity, it is a plan, our leaders cogitate supverbly & thus took 100% excellence decission for our leader not to step down.
      Lastly let’s not take comment in the web personaly, but with reason. I personally is not related to either Riek or Salva nor have I meet them personally but I beleive they are my peacefull leaders, by hook & crook I trust they will win the vote.

    Whoever thinks Kirr should step down now is only dreaming and that dream cannot come true now, the south sudan constitution allows for south sudan president to also act as the commander of the army. People have to differentiate between the National interim constitution of Sudan in Khartoum and the south sudan interim constitution in Juba, that is why we have two constitutions because each region has their own political style of governance, election nominations and army, national interim constitution one only guide the activities on the national level, meanwhile the south sudan interim constitution guide the activities inside south sudan only, which includes the south sudan president runs for south sudan presidency based on south sudan rules not Khartoum rules, but running for national presidency requires the nationa interim constitution requirements, that is why the CPA created two different interim constitutions, one for whole Sudan and one for the autonomous government of south sudan, otherwise there would have been no need for two constitutions and two governments, but that is per the requirements of the CPA that there should ber two governments be set and two constitutions be set for each region, south sudan political affairs is governed exclusively and only under south sudan interim constitution and not under national interim constitution, that is why when Kirr wants to run for the president of the whole Sudan he has to abide by the political rules of the national interim constitution, however if he is running for president of south sudan then he will have to obey the political rules as per south sudan interim constitution and not the national constitution because south sudan is a completely different government and system from the national one which is the government of national unity. south sudan constitution does allow for Kirr to stand for presidency of south sudan as per his present statue without any changes, but the national constitution will require Kirr to resign from the army this is were he will need to make a tough choice, but it will be perfect for Kirr to run for south sudan president only meanwhile another candidate should be picked for national presidency, i would prefer to see Yaser Arman or Malik Agar run on SPLM ticket for that post of national president.

    I hope some thick heads are now clear about this, there is no requirements on Salva Kirr to leave the army and so he cannot do that now, may be after 2011 referendum but will never happen now as the constitutional law is on his side if needed.

In short, these constitutions ban military dictatorship even if in defense of democracy.

    Unless the Abyei Minister, H.E. Dr. Luka Biong, who holds the portfolio of Ministry of GoSS Presidential Affairs has a private or gentlemen-agreed constitution of Southern Sudan different from what is known publicly, nothing legal can back his claim for defending the tricky situation and dilemma that H.E. Lt. Gen. Salva Kiir is falling in now as the Sudanese people enter into the real elections process. With the succession case of Lt. Gen. Paulino Matip Nhial pending, I can only remember the wisdom that says whoever digs a pit in the dark for his brother or sister, finds it difficult to avoid falling first into the same pits when surprised suddenly.

    Let us try to be legal so that we are safe as it is said. Article 111(1) of the Interim Constitution of Southern Sudan (2005) states it clearly that the President of the Government of Southern Sudan shall only be the C-In-C of the Sudan People’s Liberation Army "prior to the elections that shall be held during the interim period," not "during" the elections period.

    Therefore, let Kiir not make a mistake of forwarding his name to the NEC before stepping down from SPLA military command. It is known that Hon. Molana Abel Alier is a silent Kiiler when it comes to law!!!!

    Salvatore Kiir Miyerdit should abide by the constitutions and elections laws.

    There are three issues about Kiir’s struggle for candidacy:

    1/ Will the political bureau nominate Kiir for South Sudan presidency? Does he deserve another 5 years of corruption, tribalism and isecurity with lack of vision and development?

    2/ Will Kiir continue being an army officer (soldier)and also being the Commander-in-Chief of SPLA during the elections despite South Sudan interim constitution prohibiting it? The constitution doesn’t allow Kiir to be Commander-in-Chief during elections campaigns and voting period. He can only resume being the commander-in-Chief of SPLA after he wins the elections and sworn in as democratically elected president.

    3/ Can NEC accept Kiir’s candidacy given this and some other issues that would disqualify him for presidency either in Khartoum or Juba?

    Does it mean Salva Kiir is not aware of the Consititution of 2005? Mr. Al-Bashir of Notorious Criminal Party had stepped down on Monday, and he is busy decieving people in the North. If Salva Kiir is ready for being the candidate he must Step down and has to come out with his Slogan.

    If he is not sure for Success advice him not try it. otherwise failure to succeed means coming back home and joining the civil life and no more coorruption and discrimination.

      James Okuk must know that constitutions are written by people and they can change them according to different needs of crucial issues. Our trusts are with Salva.
      I don’t think you can’t give the milk of your child to a repentent thief to take it home.
      Diehard tribalists should think well and resolve to support Salva to remain in uniform if they have interests of South Sudan as their priorities.

        I don’t think that any wish dream against kiir and the splm will ever work. It will never work because Kiir is minding his own business besides the things that are against him and the party, and so be it the truth to know. Many opinions, many inconsiderate activities, and many hates are trying to undermine him and the aspiration which the splm is eyeing for. And any devil plan that comes against splem will have no success at all, no matter how many times those dead alive politicians are trying to bring about their best, their intended harm always fall short and it will just go without any realization effect. Guys, you leave Kiir alone and mind your lives. The guy has the moxie to endure those laying ahead hardships. He was there, he is there, and he will be there as long as he lives. His heart is not wavered by political cheaps being played around him and against him.

        Character is a test for him to remain confident in what he does. His personal character will never relinquish him to change for another identity, period. He will never presue or twist our freedom for his interest or desire, like the rest did and are likely to continue doing it, so long as they are there in public arena. Kiir’s heart is unique and is too solid to meltdown easily by accepting those claim falsehoods in defeat. We have known him for twenty years now and yet he is still that Kiir we are misjudging and messing up with. You study him many times before you rule your whatever say against him. No single account shows that he is not fit for our top ticket, no. Kiir is the most trusted person for the job among the rest who are claiming his incompetency to take the seat.

        What do you want Kiir to do, friends? He is doing the right thing for all of us. He is bringing home our golden plate which is full of liberty and individual rights, but still we are blaming him for the things that are done purposely to destroy him and our freedom. There is no need for him to step down and leave our young country in chaos. Kiir is the only fair guy among the rest to lead and bring us that freedom to the fullest, no question. You quit talking nonsense. You readjust yourselves and see things beyond borders. Be citizens of quality than being mistaken for quantity ones.

        I love seing our freedom being achieved with an equal right accaptancy. Kiir’s message is for peace and freedom for all...it is as that simple. Kiir must continue to treat peace haters and death lovers alike, in his leadership. It is a mission that has no shifted gear in it. Kiir has no pleasure for other things than be "we" freed. It is and for one a life time mission for him to finish what our nation had called him for to do. He is our Icon of hope we are all looking up to him to bring us that wanted liberty and quality of life we all have been dreaming for so long. He is the best servant we have now on the ground. And therefore, we don’t have that obligation to deny him serving us because of our corrupt political system people have been appreaching around; Kiir is the only and one guy who will continue to lead us with good heart. you stop and leave the guy alone!

      Luka biong said the south sudan constitution allows for creation of regulation within the south to allow Kirr to have one more term as an officer in the SPLA and also a political leader to untill after the referendum. no body is talking about breaking the constitution, we just want to clearify the article if it allows for that process or no.
