Sudan parliament adopts Abyei referendum law amid Messeriya protest

December 30, 2009 (JUBA) – The Sudan’s National Assembly has endorsed the long awaited Abyei referendum law one day after the passing of a similar law on Southern Sudan referendum by the legislature.

Both laws pave the way for January 2011 respective referenda exercises on possible creation of independent country in the South while Abyei choosing between remaining in the North and joining the South.

The parliament on Wednesday passed the law amid protest from the representatives of the Messeriya tribe, which described the law as a “conspiracy” against their ethnic group.

The Messeriya bloc in the National Assembly walked out of parliament before the endorsement of the bill, arguing that the tribe was not mentioned by name in the law to vote in the Abyei referendum.

Babo Nimir, a member of the Messeriya tribe in the parliament expressed his tribe’s anger by the parliament’s refusal to consider their demand that the name of Messeriya be mentioned alongside the Dinka-Ngok tribe and also to have the right to vote in the referendum.

“What happened in the parliament today is a conspiracy against the Messeriya because they didn’t even mention the Messeriya equally with their brothers Dinka Ngok. When we told them that please you have to put the Messeriya as you put Dinka Ngok, they refused this…that means the Messeriya are pastoralists; they come for grazing and they go back like this,” he lamented.

The National Congress Party (NCP) bloc in the National Assembly, however, defended the endorsement of the Abyei referendum law without amendment to include the Messeriya, arguing that it would not be amended because it had to abide by the ruling on Abyei in the Permanent Court of Arbitration (PCA) in The Hague this year.

The ruling in The Hague defined the boundaries of Abyei territory and confirmed that it belonged to the nine Ngok-Dinka chiefdoms.

A member of the NCP bloc, Ismael Haj Musa, further explained that the passing of the laws shows his party’s commitment to implementation of the CPA.

The Government of Southern Sudan welcomed the passing of the Abyei referendum bill, saying it is a great achievement in the implementation of the 2005 peace deal.

Dr. Luka Biong Deng, minister for Presidential Affairs in the semi-autonomous government said the endorsement of the law was advancement in the CPA implementation.

He however added that the next challenging phase would be the practical implementation of the laws on the ground.

Also Thousands from Abyei town flocked the streets of Abyei this evening celebrating passage of their referendum bill without loggerheads.

Addressing the rally in Abyei town, SPLM Secretary Chol Changath congratulated citizens of Abyei and their supporters for having made their sufferings known to the world.

"The world has done her best and that it is you to do your part at the referendum, either to accept return to the suffering or vote for total freedom," he said.

A commission for Southern Sudan referendum and another one for Abyei referendum would then be formed now that the laws have been passed to implement the process leading to the practical conduct of the referenda.

On another outstanding issue, the Vice President of Sudan, Ali Osman Mohamed Taha and the Southern Sudan Vice President, Dr. Riek Machar Teny, also met on Tuesday in Khartoum and agreed to increase the number of seats for Southern Sudan in the National Assembly. This is to resolve the issue of controversial results of the 2008 population census which would affect, if applied as the determinant factor, the share of power for the South in the national government.

The population census results put the South at 8 million which constitutes only 21% of the whole country’s population.

The SPLM demands that the South should continue to maintain 30% power sharing agreement in the CPA and has rejected the results of the census, arguing that they were understated.

In accordance with the 2005 peace deal that ended 21 years of North-South war, the people of Southern Sudan shall vote in the January 2011 referendum to choose between confirming the current unity of Sudan and creating an independent country in their territory based on the yet to be demarcated 1956 borders between the two regions.

On Tuesday, the National Assembly adopted key legislation setting up the planned 2011 referendum on southern independence after northern and southern leaders overcame a dispute that had threatened the country’s peace deal.

In July 21, just a day before PCA, Sudanese President Omar al-Beshir, said that the entire population of Abyei should take part in the 2011 referendum, but southern leaders resisted the statement and insisted on only the Ngok Dinka should be allowed to vote.

    As if SPLM has already deploied the right machinaries to the attack the enemies from the top to the bottom. without any doubt SPLM has done so far the best job this month by making sure that the two Bills for referenda in Abyer and the south are now successfully passed .
    Dr.Machar no wonder you have done a good job this time for the southerners, from today on i clear your name off the criminal list, better to be a changed person like yourself than being a trators like Dictator Lam Akol,Gazi and many others who finally betraied us to the hands of enemies.

      I join you in congratulating our leaders for the job well done after long time of tedious process.

      However, who are you to decide who is criminal and who is not and who gave you the power to clear or keep their names in a list? When did such leaders become criminals?

      Please the Bible says sweet and sour water cannot come out from the same pool. You don’t have to congratulate your leaders for working out your future in excellent way and at the same time calling them criminals. It is a contradiction!!!

        Now we have tested seperation by law not by war.bravo Dr Machar and Pagan without your efforts that you doubled these bills would have not been signed by NCP.
        please just form the bodies who can do well and do not select the unionists within the SPLM who can turn us into Unity,remain 12months from now.

      Brothers, let us be civilized and focus on one point at a time when it is raised but not collect what you know and apply it to irrelevant.

      It like when the Nigerian guy wanted to bomb the American plane and some one said it is SPLM-DC! That is ridiculous

      And by the way the interest of the South in Abyei has become similar to the interest of the North in Abyei! Oil!!! No body cares about Abyei as people or as a land although they are they fought hard during the struggle like all Southerners.

    Messeriya should not cry fool at the moment when it had deternmined it’s own fate a decade ago.It would be stupid and ignorant of someone to blindly assert that the CPA pitted one group of people against the other as the Messeriya claims now in reference to their relationship with the indigenous inhabitants of Abyei.Instead,it’s their past relationship with NIF where they were used as PDF against the southerners,of which Abyei people are part of,that makes them a different entity from the Ngok dinka.Therefore,they(Messeriya) should be brave enough now to face their past friend whose devilish part has been revealed by the CPA and the ’past enemies’.

      All southerners have their right to vote in the referendum whether in the South, North or living abroad. And it will be the work of the referendum commission to be formed that will identify them, their population and their tribes. Don’t worry unless you don’t know what will be the work of the commission.

      Bravo, SPLM Party.

      Good move but never rest until the last Day Southern Sudan have got their rights and their accomplishment to be free from the ruler government. The National Congress Party I hope they were thinking that, maybe the world are not paying a seriously attention to Sudan’s problems but they are really following this CPA very closely to the end of it. First of all I would like to thank the ICC Judges who have fully understand very well many situations clearly facing Sudanese people particularly, the Southern Sudanese people. There are still many things that needed ICC Judges help to rule out such as South Kordfan and Blue Nile and in addition also to South Darfuri if the Sudan Country is going to divide in to two Nations equally and so my prayer will goes to those the ICC Judges and others world organizations who have been doing outstanding supports to the suffering of Southern Sudanese people and others.

      As many people around the world were expressing their voices when the National Congress Party are about to reneging on the CPA papers which they signed in four years ago, I would like to thank also the U.S. Congressman Mr, Donald Payne who have written a strong statement on 12/23/09. He stood what the National Congress Party are trying to cheat both SPLM and the world leaders whom were witness during the signing peace agreement and I adimering people like this U.S. Congressman. I am very proud of him and I would like to thank him back and such a wonderful U.S. Congressman are the people we need in this world to solve the human rights problem and I would call upon God to keep blssing such a human on Earth.

      Back to Abyei referendum sign in to law yes, it is supposed to be pass in the beginning year ago, when every one learned from the Judges the people of Abyei will have choice during the referendum period, but the so call National Congress Party are the Party for delayment and they are Party for dirty policies, they are Party for killing innocent citizen However, they don’t get it that things are changing in this 21st Century in the worldwide and indeed our Mausoleum Dr, John Garang de Mabior did mentioned earlier that, Sudan maybe will not going to be same as it was but the National Congress Party are backing people to unnecessary policy in the Sudan.

      Despite the nine Dinka Ngok chiefdom and Messeriya pastoralists people, I think Babo Nimir of Messeriya Tribe must understand that, the SPLA was fighting for the wrong done needed to put in right way at the right time and this is the right time they Abyeians people should have the whole of Abyei land even if the Sudan is going to be in Unity, I think things should be put it accordingly to the right way in the right place.

      Babo Nimir who left parliament to protest on the law that was passing as the Abyeian people will decide in the coming year if they will throw it Abyei a way again or if they might keep it as they are absolutely title to Abyei Territory land, but the Abyei commissioner must be careful this time not to sell out your mother land. Mr, Ismael Haj Musa said, his National Congress Party has made their commitment otherwise, the Abyei Law wouldn’t pass well, the SPLM Movement was not about one thing but the whole Sudan government are needed to be change in to good vision and every single citizen in Sudan should have get right as a Sudanese citizen.

      The talks on increasing Southern Sudan seats in the Sudan level, this is supposed to be done in three years ago unfortunately, SPLM and GOSS seem to forget on this issue while it is very important and they should have did it special like the time when the National Congress Party are voting minority SPLM out in the Parliament House I think the SPLM should have blame their failure for not putting that in to practices.

      Finally, I would guess that the Sudan government knows exactly that, the 2008 Census for Southern Sudan population was made fake just to undermine the Power sharing and Healthy sharing on the Southern Sudan side. As we do know after when the Sudan nation gain independence from Kawja or the British colony perhaps, the Sudan’s population was about 15 million and within 15 million, 5 million people were the total of the Southern Sudan’s population and now the Sudan’s population range from 15 million to 42million and the questions to National Congress Party are open to be ask even if the North-South civil war have had been affected Southern Sudan in many ways as like disases and so on, I belief the Southern Sudan Census for Southern Sudan suggestion should have goes to 19 million for now Southern Sudan’s population as you can see the different after independence, anyway thanks to SPLM for being a patience Party in the Sudan.

        It has been a great year having these discussions. Some were good and others were just about passing time on the laptop! When the BOSS is out of the office!!!

        Let us start a new page and ask ourselves, How best can we use this website to the benefit of a better South we dream of and latter on we put it in reality?

        How can we use this site to hold our leaders accountable? How can we accept a different opinion with brave heart? How can SPLM, SPLM-DC, UDF, SANU, USAPs supporters have debate without insulting each others? Can we abolish words like F..ck, Dinka, Nuer, Shiluk,equatorian, Stupid, …. And use useful words?

        That way we will make the maximum use of this website to our intellectual benefit

          Are you sure you will be from North? If i were from Abyei i would have do away with all those in Khartoum not to visit Abyei land.

Dr.machar is a man being born naturally with capabilities of leader, so thank you for deriving us from extreme beginning up to this time. Therefore am really extremely happy because this time is the time where hide words are to be exposed to the general public, the referendum time is approaching us without preparation.       This is what the people of Southern Sudan and Abyei wanted to hear and be done to them by their leaders- I hope that the same thing will be done to the people of Southern Blue Nile and Nuba Mountains as they wait for their Popular consultation bills to be tabled and pass into law in the same manner too.

      The ball is now on the side of Southern Sudanese Citizens to decide their future, your leaders have now brought you, your right in a clean and clear flat plate, take it right.
      My people in Abyei, their you are again at the test, let the history not repeat itself, get yourselves back where you belong.

      Otherwise, lets workhard to make sure that, the implementation of the Laws reflects what is in the law.
