South Sudan asks to restitute money paid for undelivered grains

November 8, 2009 (JUBA) — The semi autonomous government of Southern Sudan has demanded immediate restitution of money paid for undelivered grains by some contractors to various ten southern state officials.

On Monday 2, the regional government acknowledged missing some $200 million with no clear records showing how this money has been spent.

David Deng Athorbei, the minister of finance and economic planning said his government is asking states that signed documents allowing contractors who did not deliver grains to pay back the money allegedly given to these contractors

"There are states that signed contractual documents agreeing to purchase and deliver the grains but our investigation teams revealed it had been falsely signed as they did not receive any grains," he said.

"They did it because most of the contractors were friends, family members or senior members of their administrations, otherwise this should have not been done," he stressed.

The minister said decision to ask for restitution of the money paid for undelivered grains was discussed and agreed by a ministerial committee formed to follow the case.

The issue was also discussed at southern Sudan council of ministers which according to him had endorsed decision of the committee.

The committee has started summoning some state governors to consider immediate repayment. He added that if they fail to refund the money, the ministry will be forced to cut it against their annual grant budget.

    The best way to do this is through the court system. The judge would decide in the court of law to set restitution. But you can’t set restitution without guilty party. Who are the guilty parties? The rule of law has to take its course. the two ex-finance ministries and their accomplices need to face court actions and then the truth comes out.

    I do suspect Deng Athorbei is currently acting as a judge and prosecutor on these cases to cover up the investigations. There needs to arrests in this situations. Otherwise, the rule of law is simply a political joke in south sudan. South sudan fails in all sectors. Justice, Finance, Kiir’s Political leadership and much more!! Pathetics!!

      GOSS under Kiir leadership should understand that this is elections’ year. Six months from now are too soon. It has to do every thing to motivate people to register and vote for them. People are confused about the SPLM’s contradicting statements of boycotting elections and not nominating its candidates. Citizens are also fed up of the failure by the government to deliver.

      Look, I watched it on SSTV, heard it on radio and read it in newspapers a few months ago that the government resolved to pay house rent allowances to the civil servants beginning from January this year. Up to now nothing has materialized. Is this a joking government or what? How come a government makes a decision it cannot implement? Giving false hopes to citizens is dangerous and can backfire at the government. May be the money is there but those official thieves in the finance ministry want to delay the payment until accounts are closed by the end of the year and they eat the money for this year’s house rent allowance. Is this a behaviour of a government that goes for elections really?

      I hope Kiir will give some incentives to the government staff during this long holiday, otherwise people will just sit down, playing dominoes and cards and not bothering to register to vote for a joking government.

      • What is the connection between corruption and misappropriations of funds and elections? Don’t take unrelated issues and lump them together so that you can find a cover to attack the SPLM position. You are complaining that Riek’s decision to capitulate to NCP is being undermined by the party. Clearly, you are nothing more than Riek’s houseboy. If you Riek supporters want to create a party to compete with SPLM, go ahead. You tried it in 1991 and 1997 and it didn’t go anywhere. Third time is a charm?

        The Greater Nuers enslaved the Dinkas!! They used strategic move and vision to make John Garang & you signed up for Self-Determination in 2005, thus leading to Upcoming Referendum. The Nuers fought Great Britain, Turks & Arabs while Dinkas were getting busy being enslaved by both European and Arabs in the 19th Century. The Nuer extreme freedom is real and it is always applied to any oppressors fearlessly. This is why there was Ngundeng Rod in London.

        The Nuers are fearless nation and can take on any aggressor. But the Nuers are always humble, and assimilated or converted more Dinkas & others and made them leaders among their communities. It is so-called soft-power. They used assimilation as a tool. The Nuers use their egalitarian system to welcome the disadvantage from diverse background to make them feel home in Nuerland. One can only be Nuer through characters, raised by the Nuer traditions and values democratically with no discrimination. Therefore, the Nuers will always be your nightmare. You guys were lucky Dr. Riek Machar is your top protector in south sudan. But miss behave again and you ’ll see the Nuer’s wraths. The single ethnic group that is a pain in Dinka’s bud is the Greater Nuers in south sudan. It is all time!!

          Nuer are humble!!! what a joke! you made Garang to sign CPA and you can’t provided evidence.CPA was signed under the SPLA/M Torit or Nasir faction. Why Riek didn’t signed it instead? what about the peace Dr. Riek signed in 1997 what happened to it? It didn’t work because Garang didn’t signed it right? so Nuer enslaved Dinka through forming militias and betrayed other southerners right. The only things Nuer are good at are; forming militia, betraying southerners, traitors and being used by the south Sudan enemy. good luck

          Where do you think Riek Machar would currently be if Dr.John Garang did not permit his return to SPLM/A? Everybody knows the answer!

      Mr David Deng sound to be the only uncontermainated creature from his entire community. I expect that If the money is returned, it should be use for another plan not to be taken straight into individual account. Those states which where reported as been rescued by WEP are resposnible for this money, their governors who register 200 fake names in their pay slips are responsible, they must repay this money otherwise loss their jobs and jail on top. We need people who struggle for South Sudanese benefit not tribalism and corruptees. David Deng should advice his Kiir on how to act and behave. Some of thise money might have been spend on food, because for the last few weeks Bor didn’t interface with murle and nuer by selling their kids for food.

      I gree with you because without justice nothing will go right in the south. The two former finance ministers, Arthur Chol and Kuol Mawien should immediately face justice according to my point of view.However,that option will not and shall not be possible. Do you know why? Because the two ex-ministers for finance in GOSS + GOSS Unticorruption Commission are all from the SPLM Party which came from Heaven.

    • It is very shocking to hrear from the investigation committee formed by the minister of finance that the money that went into idividuals pockets will be refunded back from the states funds!! is it a joke!! why the government is not arresting those responsible since it is not a complicated case?, Akuien Chol and Kuol Athian with their staffs are well know so why punishing innocents people who spent the whole year with out salaries leaving criminals enjoying in the wrong time with wrong funds. Kiir please, please if you are unable to end this drama then leave the field to some one who can end it. It is not in Dinka culture to hear every day that your children steals things belongs to other people and do nothing to stop that, its means you are the one telling them to do so. You are lucky to rule a blessed nation like South Sudan otherwise things that happened in your time never happened during the struggle years so please wake up and feel ashame. there is no way to implement the decision of the minister unless these amounts must be taken from the states of former finance ministers if the government is fearing any resistance from their state`s citizens.

    Many thanks Minister Deng, these are values of good public servant, it is the best public interest to publicly mention those who signed bogus contracts to embezzle public funds. Honesty and accountability are essential values of democracy. Thump up the change needed is dimly emerging when transparency is upheld in public sector.

      This really very funny!...will be forced to cut it against their annual grant!!These are $ 200 millions !let us do simple calculations.

      Suppose the monthly salary is $ 2000 (that is more than 5 million sudanese pound.The annual salary will $ 24,000 and if he works for 30 years all what he will get is $ 720,000. this is less than hone million!

      These are all SPLA freedom fighters, nobody is going to ask them.The Minister of finance should know that there is something called THE LAW AND ,all involved should go to jail first and they should be asked while they are in jail.Giving them a chance to leave the country , buy a new house in Australia , put 1000,000 in the bank with an interst rate of 3% only per annum he will gurantee a monthly income of $ 25000 and live like a king!

      Salva Kiir should know that these are the thieves who are making the tribal wars, and not the Jalabba!They do not want elections . SPLA WANTS TO REMAIN ON POWER FOR EVER, TO CONTINUE LOOTING THE MONEY OF THE POOR MARGINALIZED PEOPLE OF SOUTH SUDAN.

      • The X minister of finance must face justice before the Governors are summoned.

        Yes it’s through that the contractors are friends and Families of the top officials start from the minister to the Governors, especially Warap state, Lake State, Jonglei state, Northern B, and Western B. states. The great aweil individuals who are offered the contracts through friendship and nepotism should make sure that they have devolved their states, not to sleep at Taraf Bahari expensive hotels forgetting that their minister was fired mid this year. That is the last chance that they have and there’s no any other one behind this. Kwal Athian must be investigated where he had that money he constructed the upstairs building located at the Airport road with an amount of $$4000000 and one at munuki with $3000000 out of the ones he both abroad.

  • Restitition of public money is really magic word and action that would save us, north and south, from humilation of begging, suffering or starving. We need no donations or gifts from whoever had we restituted monies taken by our not honest officials. I feel it should be institutioalized all over the country, not one part. If that is impossible then let us know them for the day of reckoning.

    Lack of management within the Government of Southern Sudan is a big fundamental issue. It sound useless always when the Ministers of Southern Sudan Government demands help from the other donors for all the times. It is not bad to be helped anyway, but there is a time in which you can be helped by somebody and a time you can helped someone else. This time is the time for Southern Sudanese Government to rise help to other countries such as Somalia, Burundi, Rwanda and many other countries, but it is not a time for Southern Sudanese Government to loot their own properties. Southern Sudanese civilians including the SPLA Soldiers who were been fighting with Arabs from Khartoum Government and also with some extremists people within Southern Sudan are now suffering and it is good for the Southern Sudan Government in order to work on those measures surrounding the Southern Sudanese Communities in whole.

    By the way, who is really carrying an "EYE VISION" amongst the top leading Southern Sudanese leaders such as Salva Kiir Miyardit, Dr Riek Machar Teny, James Wani Igga, Oyai Deng Ajak, Paulino Matiip Nhial, Paul Malong Awan, Daniel Awet Akot, Maliik Agaar, Deng Alor, Luke Biong Deng, Edward Lino Wuor and so many others as well? Amongst those leaders mentioned above, who is a substantially the host victory of "VISION" who demand a sustainable and everlasting autonomy(Freedom) to the Southern Sudanese Civilians? Simply, the answer is naive. It is not good all the times to hear that Southern Sudan Government lost some money. Now in Juba, Wau, Malakal, Yambio, Torit, Mundiri and many other towns, children under the ages of 10 to 12 years are walking under the streets and Southern Sudanese Government Ministers have never yield their visions to these young children whose fathers were been killed in war. On the other hand, these street-young children will later on adapted a very hostile life whereby they can not lives happily and as a result, they will become thieves because no one is taking care or minding of their future-life, while Southern Sudanese Ministers are investing and modernizing themselves.

    Southern Sudanese Ministers complaints that, $ 200 millions get lost in unsure way which is not known by the Government of Southern Sudan. First of all, $ 200 millions is not an easy money to put a game on it. If the investigation is carried out right now in Southern Sudan, then many of the Southern Sudanese Ministers maybe the can be found embezzling this sum of money including the head of SPLM/SPLA and his Vice Chairman.

    I see it now in Southern Sudan that those of the Arabs from the Northern Sudan are they people who are being expected by the Southern Sudan Government to bring grains to the Southern Sudan civilians in so that the Southern Sudanese Civilians should buy the grains from Arabs. How come that Arabs from the Northern Sudan become again as our suppliers? Do Southern Sudanese Ministers forget or know how Arabs come to Sudan? It should be sincere when they complaints that $ 200 million is squandered by some of the Ministers within the Government of Southern Sudan like the way they use to. "LEAVING ONE EGG OF SNAKE AND ONE EGG OF HEN IS A PROBLEM". What are these eggs that I’m talking about?.

    You know who took the grains and failed to delivered them. Those theives must be taken to court. I don’t know why the solution is to cut the money from the state anual budget, while we know the person who stole the money.let’s try to be fair please.
