Sudan’s SPLM gives ultimatum to NCP over law package

October 12, 2009 (KHARTOUM) — Sudan ex-Southern rebel group today issued an ultimatum to its partner in the Government of National Unity (GoNU) saying the dominant National Congress Party (NCP) has week to agree on a number of draft laws.

The laws include referendum and national security laws hotly debated with the NCP for most of this year.

The SPLM submitted a memorandum to the parliament speaker saying that these laws need to be tabled within a week or else they will boycott the national assembly.

“We are going to boycott the whole parliamentary session if they do not respond positively,” Yasir Arman, head of the SPLM’s northern sector was quoted by Reuters.

“There is an absence of political will from the National Congress” he said.

The SPLM stressed that this is the last session of the parliament before the April 2010 elections and thus these laws need to be passed as soon as possible.

The NCP asserts that Sudan National Intelligence and Security Services (NISS) should have more powers, such as arrest and confiscation, than simply gathering information; something the SPLM says is contrary to the 2005 Comprehensive Peace Agreement (CPA).

Furthermore fundamental disagreements persist between both sides over the sensitive issue of referendum.

The SPLM has proposed 51% while the NCP proposed 75% and recently raised the stake to 90%.

There are also disputed post-referendum issues including discussions on what to do with the liabilities, assets, water, Joint Integrated Units (JIU’s), oil, international agreements in case the South would vote for separation.

The parliament speak Ibrahim Ahmed Al-Tahir accused Arman of having “his own agenda” fearing that as a Northerner he fears passing the referendum law pointing to the SPLM figure accused of homicide back in the 80’s which might be reopened if he loses parliamentary immunity.

However he stressed the NCP’s commitment to resolving differences with the SPLM over these laws.

      Wow, I have got very interesting quotes in this article. About three of them that I want to comment on:

      I agree with the SPLM that powers of this NCP’s notorious so-called National Intelligence and Security Services (NISS) must be cut down. This NISS has gone beyond what it should be doing. In the South under the NCP’s Deputy Director, the so-called (Dr.) Majak Agot, this NISS has even involved in combat fights against civilians like in Duk Padiet, Bor-Dinka and Mundari fighting and in Rumbek. It should be told it is supposed to be, not a party to tribal wars.

      2) "The SPLM has proposed 51% while the NCP proposed 75% and recently raised the stake to 90%."

      This above second quote is a complete misunderstanding of what is being discussed by the SPLM and NCP. To my good understanding, there are two issues of requirements, one on the percentage needed to declare the South independent, which have two proposals, 51% (SPLM) and 75% (NCP). The NCP has never raised its 75% to 90% on this issue as misunderstood by whoever wrote this article. But it has proposed a different percentage of 90% ONLY for the registered voters turnout on referendum day. This 90% includes those who may vote for unity and those who may vote for separation. Some writers or reporters should not mislead the readers on these two separate issues.

      Wow, that is interesting. It is called blackmailing. Al-Tahir wants to blackmail Yasir Arman that he was a wanted criminal who scape to join the movement and only fears the current laws because his might be re-opened. I thought there was a general amnesty and this was why even late John Garang was allowed into Khartoum and was sworn in as First Vice President. Speaker should stop using such tricks, which to him, only justifies the SPLM’s demand to repeal national laws in the country.

        Nothing appeared atractive from Salva Kiir’s leadership as a president of southern Sudan than being just a Dinka leader following all related series of violence and political mess in southern Sudan, believed to be initiated by him and his subordinate from the Dinka clan within the household Juba government.

        Therefore,don’t tell us more about him, we know who is he as a person and leader as well.Oshay has right to always comment tough agitated words against your stand because your character still related to that one of Khartoum government base on buying time,political spin and puplic mislead statement and policies toward general goal. Don’t think southern Sudanese are under your shadow as a Dinka to mislead them to serve your will in voting for separation so that you can come and rule them.It will never happen unless when there would be egalliterian in southern Sudan that could satisfy everyone across the region base on ethnic representation in both federal and state government.Watch out for this awful acts.

      Nubian people are not Arab even though some of them are Muslim believers that is not what we Southern Sudanese people wanted, we just need every one in Sudan to have right for all kinds of rights, citizens have right to say no / yes, that is what we needed since all Black African Tribes in Sudan have been neglected by this 39% population Arab Minority group then, these Days could be the bad Days for Arab dominators and yes, we would be united as one people and we will fights with those who dominated us and killed our innocents people in the Sudan.     As long as Riek machar is the head of referendum law, the progress will not take an inch.
    This dwarf brain leader will not bring any progress to the referendum law.
    The best way the splm could act is by replacing him with Wani Igga and Deng Nhial.

      I do not know you guy if you are in uproad or you realy resident in South Sudan or Sudan as whole let me tell you your uncle Wani Igga Will not do any thing for South look even how he address the citizen in media he behave like crazy person do you mean such person can formulate a laws which govern referendum I know Nhial Deng Nhial will do it but according to his position that he holding in the government of Southern Sudan will not do it ,Dr Riek Machar is the right person who led SPLM team because is a vice president of GOSS at the same time for his qualification, please don’t in your mind Wani Igga can rule South Sudan is given that post because there was no some body from Equotoria who struggle with Late Dr John during the war as you know all of you fled to Uganda ,Kenya and DRC.

    I encourage the SPLM to stick to its strategic demand of giving the NCP a single week to positively response to the issue of referendum bill otherwise withdrawing from that lawless parliatment as suggested by the SPLM members is the only wise decision to make. Remeber that wwhen the SPLM withdrew from the Unity government when the NCP interfered with the SPLM reshuffling its ministers, the NCP responded positively. This tell us that NCP act when there things are tough. So please go ahead SPLM and God will always stand with you since your presence in the Sudan is to rescue our counrty from all odds.

    God Bless South Sudan and all its Tribes, big and small.

      I disagree with Khartoum NCP to give all powers to NISS for randomly arrest to Sudanese citizens in the country. I can say election will not be fair and free if that thing will happen as restriction of citizen. I encourage SPLM to strength themselves to fight for the right of all Sudanese in the country since NCP doesn’t want better understanding with his citizens. In addition to that, I concur with SPLM for 50%+1 to make 51% to win the referendum vote for 2011 and whatever NCP is saying is total destruction of CPA as the bite drum of War indirect.
      Second to that, I know very well, we have certain groups in the South who always like to weaken SPLM and collaborate with Khartoum regime all the time in their life. Look at the leaders like general Matip who always think negatively toward the South independent and became aggressive to his colleagues in the South for small misunderstanding among the military. I don’t know why Nuer dislike each other in leadership even the right person like Taban Deng Gai who is doing his best to upgrade his community of Unity state? I’m not happy with Ngungdeng to curse Nuer people than to pardon them since he known their hostility and low capacity of understanding as none of them think positively. May God pardon Nuer and forget the Nguengdeng curse so that they will improve their standard of living with others in the society.

      SPLM/A should have taken such steps long ago,but because of some weak leaders who either scared from Jalabas or having some personal interests like Lam Bin Akol from Bani Shuluk, and Tilar deng from Bani Dinka.

      However, nothimng is lost, but the problem of SPLM/A is that it doesn’t know its real size in Sudan. NCP is just bluffing with quacking and sound of the broken wings while is has nothing even in the North of the Sudan.The supporters of NCP in the Noth are only those working NISS because without them these Holligan must have gone long ago.
      With all means avialable SPLM/A must thwart the NCP the will discover that all Sudan in behind it

        NUER NGUNDENG HISTORY,

        The demographic consequence of Nuer expension/occupation brought a big effect on Dinka, Anyuak and Burun population repectively in the Sudan and Ethiopia. The fate of the Dinka, Anyuak and Burun inhabitants of areas appropriated by the Nuer remains to be considered.

        Available data indicate that direct mortatity from Nuer invasions/raids has a negligible effect on the Dinka, Anyuak and Burun population over the long term while the taking of captives had a very significant effect. This is a consequence of the distinctive age and sex distrubition of casualties and captives respectively.

        Most of the people killed in Nuer invasions/raids were men and older women while most of those captives were young women, girls and boys. The population would thus be reduced by the difference between the average age and nomal life expectancy of those killed multiplies by the annual casualties rate.

        In contrast, the loss of a female of childbrearing age or yougner through captive remove two individuals from the population in the next generation representing the demographic replacement of these absebt offspring are also lost the following generations.

        Since boys, girls and women of marriageable age were the objects of capture, older women probaly account for the majority of female casualties. Nuer invsions/raids are always resulted in the capture of substantial numbers of women and children than expension/occupation itself. And the number of captives taken also outnumbers casualties.

        However, it seems likely that the preponderant majority were females who would generate bridewealth cattle for their captors when subsequently given in marriage to other Nuer men. The Eastern Jikany Nuer invasion/raid on the Burun in 1918, during which 250 young women and 400 children were taken along with 2,800 sheep and 800 head of cattle.

        One of the most significant points that emerges from consideration of Nuer-Dinka, Nuer-Anyuak and Nuer-Burun conflict during the early coninial period is the extent to which the female segment of the Dinka, Anyuak and Burun population were affected by Nuer Warriors invsions/raids.

        The number of cattle captured by the Nuer in large scale invasions/raids on the Dinka is surprisingly large, especialy gives the fact that the Dinka, Anyuak and Burun strategy of withrawal was predicated on minimizing stock/cattle losses. In 1914, over 5,000 cattle were taken away from Ghol and Nyarraweng Dinka in 3 days raids alone while a number of Bor Dinka and villages futher south lost all stock.

        The capture of a single Dinka or Anyuak woman or a girl thus reduces the Dinka or Anyuak population by four individuals in a matter of one generation later, and adds a like increment to the Nuer population. Moreover, it is evident that the annual capture of a modest number of productive females would over the long term, effectively transfere a substantial portion of the reproductive potential of the Dinka, Anyuak and Burun population to the Nuer. This is of considerable importance because it suggests the same invasions/raids that were instrumental to Nuer expension/occupation also resulted in substantial additional to the Nuer population.

        Just to make a long history short, we can take a comparason between the Nuer and Dinka of Greater Upper Nile State, the Nuer of Bentiu and Dinka of Bahr el Ghazal, but keep in mind Bahr el Ghazal is a land of many tribes such as; Blanda, Jurchol, Dinka and so forth. It doesn’t need someone to wait for the Census of South Sudan and find out which tribe is the majority in the State of Greater Upper Nile (Upper Nile & and Jonglie). And when we come to Nuer Genesis homeland (Bentiu), there is no doubt it can outnumber the Dinka Bah el Ghazal population.

        In short, one may conservatively conclude that less than 50 percent of former Dinka (Luach, Eastren Ngok, Nyarraweng, Ruweng, Ghol, Padang, Angai, Dungjol, Twic, Bor, ect) and Anyuak inhabitants of the East of the Bahr el Jebel appropriated by the Nuer took refuge in adjacent areas to the north and south.

        Therefore, Naath/Nuer is not only the brave ethnic group in East Africa, but the 1st largest tribe in South Sudan at the same time.

            your article should stand on its own because it’s not pertinent to the main article.
            However, your fiction is not corroborated with any references if at all there’s any. Why don’t you go on the ground and check by yourself how great in number Dinka is? You can choose either Aweil, Warap or Rumbek (no one will harm you);just one and go back to where you are. I’m sure you’ll totally change your article.

        The NCP Luciferian Agenda
