AU not vouching for Bashir’s innocence: Kenya FM

August 5, 2009 (WASHINGTON) — The Kenyan foreign minister Moses Wetangula today defended the resolution adopted by the African Union (AU) granting reprieve to Sudanese president Omer Hassan Al-Bashir from arrest in the continent.

Al-Bashir is wanted by the International Criminal Court (ICC) on seven counts of war crimes allegedly committed in Darfur.

However, the AU decided in its semi-annual summit last month that African ICC members shall disregard their obligations to cooperate with the court in apprehending the Sudanese head of state.

“The AU does not and has not and will not say that President Bashir is innocent, because we have no capacity to say that. He has been investigated, he has been indicted,” Wetangula told reporters at a press conference with US Secretary of State Hillary Clinton in Nairobi.

The top Kenyan diplomat said that the AU wanted the UN Security Council (UNSC) to invoke its powers under Article 16 of the Rome Statute to suspend Bashir’s indictment for a year.

“The Security Council could suspend the warrant for a year because there was visible progress in Sudan, that there was internal discussions, there were talks going on in Qatar, and we wanted to see whether that texture can bring relative calm and peace in the country,” he added.

The UNSC is divided on the issue of invoking Article 16 particularly among Western members of the council who say that progress need to be made before the arrest warrant could be deferred.

“Nobody will stand in the way of President Bashir being arrested and prosecuted, but for now, the AU’s position is that let’s see what internal mechanisms can be done. I don’t think the AU is asking for too much,” the Kenyan foreign minister said.

Wetangula did not say whether Kenya, an ICC member, is prepared to arrest Bashir if he was to visit despite the AU resolution.

Kenya is currently mulling the issue of prosecuting those responsible for 2007 post-election violence. If the government fails to setup a special tribunal within a year, it will refer the situation to the ICC per an agreement signed last month with the prosecutor of The Hague based court.

The US Secretary of State standing next to Wetangula appeared critical of the AU position.

“The United States and others have continued to support the need to eventually bring President Bashir to justice, but he’s found a lot of protectors, and mostly in this continent, where people have allowed him to travel and have not used the forces of their own judicial and law enforcement institutions to arrest him, to turn him over the ICC,” she said said.

Clinton added that the ICC arrest warrant for Bashir “is a very significant step by the international community”.

“The actions by the ICC sent a clear message that the behavior of Bashir and his government were outside the bounds of accepted standards and that there would no longer be impunity,” she said.

However, she pointed out that the process of bring Bashir to court “takes time”.

“If you look at some of the international tribunals, there are periods of time during which the investigation takes place, if it does get started – in this case, it did – then if an indictment is returned, there is often time before the person indicted is brought to justice,” Clinton told reporters.

In a related development today Ghana’s foreign minister Muhammad Mumuni said that his government would not arrest Bashir if he visits despite being a country that ratified the Rome Statute.

Mumuni said that this position is in line with the AU decision taken in the Sirte summit adding that his country nonetheless respects the ICC, according to statements published on the Ghanaian based ‘The Statesman’ newspaper.

In Kampala today, the Chinese special envoy to Africa Liu Guijin reiterated his country’s opposition to the ICC arrest warrant for Bashir and the leaders of the Ugandan Lord resistance Army (LRA) also wanted by the court.

“The involvement of the ICC indictments at a moment when there is need for a greater push for more political solutions is not solving the purpose,” the ‘New Vision’ newspaper quoted Guijin as saying.

“If Sudan is on fire, the international community should put out the fire,. The situation in Darfur is very complicated. We need a comprehensive approach to address the problem,” he added.

China has pressed Western members of the ICC to agree to suspend Bashir’s warrant but at the same said it will not table such a resolution and instead called on African countries to work on it.

Guijin’s visit comes weeks after Uganda asked Sudan’s Bashir not to accept an invitation to a summit it is hosting to avoid a “diplomatic incident” pursuant to their membership of the ICC.

The UNSC issued resolution 1593 under chapter VII in March 2005 referring the situation in Darfur to the ICC. At the time, African members Tanzania and Benin voted in support of the resolution while Algeria abstained.

  • Why is there this hyper attention on Sudan and President Bashir. Bashir has ended the longest civil war in Africa, he didn’t need to, the SAF was not losing to the SPLA, but many dumbass southerners think that this man is evil while at the same time whitewashing the history of the tyrannical Garang.Uganda is still in a civil war but only anti western rebels have been indicted yet the ethnic cleansing of the acholi bu Musevini has not been charged.

    Sudan doesn’t need any support from the world’s beggars (Africa) all it needs is its people to stand behind its president. Bashir might have done some bad things in Sudan but the hypocritical ICC has no right to charge him.

    As a matter of fact I want Bashir to resign and replace him with a real hardliner and quell the SPLA like the Tamil Tigers.

SAF was staying in the control towns like prisoners,Bashir was not having control over the people outside towns in the South Sudan as SPLA was all over the country side, SAF was losing a lot although you always talk opposite for the sake of your survival in the North. The war in Sudan was made longer you people, think of what happened in 1991, Dr.Lam Akol and Dr.Raik Machar formed SPLM-United only to end up in Khartoum and then both men ran back to the SPLM mainstream after they rediscovered Arabs blackmailing. "Set a black man against his felow black man and they will finish themselves, said Arabs and the whiteman,"... What I know of Oshay is that, he is last informed.

      Please, if you are man born to serve his people and not born to live by the blood of his people, then ask Dr.Lam Akol and Dr.Raik Machar what happened to SPLM-United, and why they went back to the SPLM mainstream?

      Oshay.I dont think SPLA is like that same age old TIMAL ILEUM rebels in Sri Lanka that was mainly formed to fights for the rights and freedom of the ethnic Timal Illuam (Homeland),in term of military capabilities.You can think of other means but not military confrontations btn SAF & strong SPLA man.SPLA is invincible force as you can imagine which rebels had ever control such a dictatorial and genocidal regime for 21yrs even when the war was voluntarily fought by SPLA with a supports of their local people.On the day Basir ponder of such will definitely mark the end of Arabisation in Sudan history.U needs to reads more historical books about global affairs b4 u makes comparisons.

      I hear a familiar voice of a well known name in the above commentaries calling for al Bashir to resign and be replaced by a real hardliner. What a wish! And I pray that God answers it for him.

      We all know that al Bashir is a hardliner and even if some people would want us to believe otherwise.

      The fact remains that, all those surrounding him including the above admirer are, in spite of their being fully appreciative of the naked fact that al Bashir is now more of a liability to the NIF/NCP than at any time before, yet none of them dares to risk his/her life by saying that the Emperor has no clothes on.

      Enough for our above friend’s wishful thinking. In any case if al Bashir resigns, no wonder that the event will definitely go into the Sudanese dictionary as “Dagsat al Mualim”, of which the consequences are even far beyond the so-called mosquito buzz of The Hague.

      But as to why the African beggars are crying over al Bashir, well these are no different from your own cries and tears and the rest of the Sudanese. They are mere crocodile tears, which are involuntarily shed throughout the whole of the African Continent including its neighbours in the Middle East.

      I am sure you know all these as it is part and parcel of your history.

      But before you talk of teaching the other Sudanese your so-called Tamil lesson, I want to draw your attention to the free invitation to the French-Chadian party not too far from your own military barracks in Darfur and you will have to dance to that party first.

      If you survive it then send your indicted friend to the Hague to leave a room for your imaginary hardliner in Khartoum to come and show us what you have learnt from the western borders of Darfur.

  • I think we have no time for all of that talk. Justice and peace must go hand in hand. Whether those indicted are guuilty or innocent is a matter the court must decide. Therefore Kenya is obliged by the international law to arrest those wanted by the ICC. As a signatory to the Rome Statute, Kenya must arrest Bashir if he appears in its territory.

Bashir is wanted by the international criminal court (ICC)for war crimes and crimes aganist humanity he committed in Darfur and Kenya seems to be blocking his indictment. I so wish Kenya government first know what type of crimes he has committed before it stand to defend Bashir. So Kenya government must know that up to 2.5 million people displaced and 300,000 thousand killed in Darfur which have never happened in Kenya and Bashir is behind all these. Kenya has just experienced a minor election violence of recent and had already reported it to the Hague while they keep blocking the must tribble crimes Bashir have committed

  • Regarding to the Kenyan foreign Minster statement issued on this article, I don’t see any reason to raise war’s flag against Kenya, the man simply was stating the (AU) failure to convince (ICC) to reprieve the Bashier’s arrest for one year under Article 16 of the Rome Statute.

    I don’t think you guys had a full scope of what the article was about or simply you misinterpreted its contents.

    Before we clap hands or praise the (ICC) efforts to Arrest President Bashir and bring him to what so called International Justice, we as Sudanese in general ought to consider the consequences on the ground, don’t you recall that most of the Northern political parties have a different attitude on the fragile (CPA) between north and south, what to you think the outcomes if Bashir is to be removed from power before the final implementation of the (CPA).

    Taking Bashir to what so call International justice will not bring us back the innocent lives we lost in Darfur or stability to the Darfurian, what needed is a final settlement similar to that of (CPA).on the other hand, If we call the SPLM/A leaders Heroes, then we ought to admit the fact that Omer Al-Bashir is too a Hero and the wisest man ever ruled Sudan. The CPA was a join effort between the SPLM leadership and the Sudan government headed by Al-Bashir, and most of all the two parties agreed to put an end to 49 years old war in Sudan even if that will leaded to separation of the south from the north, in fact the two leaders deserve a Noble prize for peace.

    Well, I would like any Sudanese to ask (him/her) self why in such a crucial time in our history, where our leaders began to have the conscious, willingness and ability to solve our domestic conflicts the west began their campaign against our leaders, the most appropriate answer would be because the west will lose grip on Bashir for good if ever succeeded to solve the Darfur issue, the pretext to the Darfur Rich Uranium mines would be lost, this rigorous campaign against Bashir is not for the sake of Darfurian people, I pretty much doubt it, 2.5 million innocent civilians life were perished by the hand of the Sudan government and yet not a finger was raised by the International Community, and why waiting till the 10 or 100 thousand innocents lives to be lost in Darfur, the UN would interfered to stop the atrocity if they wanted, but that would leave them with no subject to built their allegations on, the choice was to let those souls perish so that they would have a strong case against Bashir…what paradox ..? As the late singer Michael Jackson once sang( all I wanna say that they don’t really care about us!)

    What has changed for the sudden? It isn’t the USA who armed Khartoum in 1980s? It isn’t the British who handed over the Sudan government to the north leaving south with nothing? It isn’t the British who gave Abyei to the north in 1905? It isn’t the Sweden Government who supplied the Bashiry government with weapons before China did? It isn’t the USA Presidential envoy who is seeking for a permanent reconciliation between Sudan and the US? It isn’t the PCA who gave Heglig and Mayram to the north? How pathetic are we to believe that our salvation will come from those who built their civilization by our ancestors skeletons and how fool are we to follow blindly those roads which lead to our inhalation!

Sri Lanka is an island nation unlike South Sudan. All his Arab Jehadists won’t defeat us in South Sudan. The 21 years war was mainly fought by blacks vs blacks. He must to read the current situation in Sudan. They are being surrounded and should think thrice before speaking. Bashir remains a war crimminal whether he is arrested or not. History is there waiting for him and Arabs in Sudan.

    I don’t know why people crack their minds for know reasons. Omar Bashir, is comfortable in his office in Khartoum. This is not the first time for Omar Bashir to threaten people. He use it from the very beginning and even the whole Southern Sudanese people including the leaders of the Government of Southern Sudan know it very well that Omar Bashir is an arrogant leader in Sudan. But my point is that, who is capable amongst the Southern Sudanese leaders in order to expelled away Omar Bashir from his presidency since the SPLM/SPLA aims were to liberate and fight for injustice being practiced in Khartoum by Omar Bashir and his Parliament associates?

    What I do see from our Southern Sudanese leaders is just only to support Omar Bashir from not being arrested by the ICC. If SPLM/SPLA leaders limited themselves away from Omar Bashir and leave ICC in order to deal with Omar Bashir, then I hope things will go will. But, what make Omar Bashir to be so tough in front of the world communities were the SPLM/SPLA leaders who always emerged when they heard ICC accusing Omar Bashir and takes preemption before ICC did anything to Omar Bashir. My blame go back to the Southern Sudanese leaders who are deeply lack of political strategies. Omar Bashir can not go unless Southern Sudanese leaders can use a firm political dialogue in which they can not confederated themselves with Omar Bashir. All the world communities are now getting confused because when they tried in order to emerge into the problem of Southern Sudan in term to help the Southern Sudanese people, then people within the Government of the Southern Sudan come out with their own political views which affect the world communities to energizes the innocence people who were been recuperated and suffered in hand of Omar Bashir. Instead of Southern Sudanese leaders to co-operate and join their hands together with the ICC, they rather decided to rejuvenated Omar Bashir. God will judge on how Southern Sudanese people should become a sensibly community in the world.

      Time has come for the marginalized black Africans in Sudan to take the government in Khartoum domocratically. Although SPLM remanins the only hope for the people of Sudan, it has killed the aspiration of the people of Sudan and undoubtedly failed to unite the Marginalized people of; Eastern Sudan, blue nile, nuba moutains Dafur and the South Sudan to easily throw ALbashir and his NCP away and forever, we realy lost our dear leader Dr. John Grang whose abitions were not less tan rulling the whole Sudan.

      Can Somebody tell me why we still dont have a candidate who is confident enough to challenge Abashir in elections?

      We should not complaint later, since we can not rule the whole Sudan, Khartoum will not let us alone even when we seceed.
