ICC judges issue an arrest warrant for Sudan president

February 6, 2009 (WASHINGTON) — The Judges of the International Criminal Court (ICC) will soon release a decision in which they agree to issue an arrest warrant for Sudanese president Omer Hassan Al-Bashir, Sudan Tribune has learnt.

The ruling that could be made public as early as next week will make Bashir the most senior figure to be indicted by The Hague based court.

The Pre-Trial Chamber I which is assigned the Darfur case has been reviewing an application submitted by prosecutor Luis Moreno-Ocampo last July requesting an arrest warrant for Bashir on three counts of genocide, five of crimes against humanity and two of murder

There was no confirmation on which counts the warrant was issued for, but one source suggested that it will include the charges of genocide, which is considered the gravest crime in international law.

Last week the ICC prosecutor sent an urgent notification to the Judges after which they met with him on Tuesday in a closed session along with the court’s Registrar Silvana Arbia along with representatives from the Victims and Witnesses Unit (VWU).

The meeting likely discussed measures taken to discuss risks associated with unsealing the warrant.

The decision, which remains under seal, will be transmitted to the UN Secretary General Ban Ki-Moon shortly according to multiple sources. The ICC prosecutor is currently present in New York.

This week Ban who was present at the African Union summit warned that Bashir must adhere to any decision made by the ICC.

“He [Bashir] should fully cooperate with the decision of the ICC” Ban told a press conference on the sidelines of the summit.

Arab, Islamic and African countries have called on the UN Security Council (UNSC) to defer the indictment to so as not to jeopardize the peace process.

The warrant may make it difficult and even embarassing for world officials to meet with Al-Bashir or to receive him on their territories.

European Union (EU) laws prohibit their officials from meeting with individuals charged by the ICC.

The UN and many other Western embassies in the Sudanese capital have created security plans aimed at protecting their staff from any possible backlash following the decision.

Sudanese officials have pledged to ensure safety of Western missions and UN staff but cautioned that they may not be able to control any outlaws.

The UN Security Council (UNSC) issued resolution 1593 under chapter VII in March 2005 referring the situation in Darfur to the ICC following recommendation a UN commission of inquiry into abuses committed in the war ravaged region.

      Nuer, Frog doesn’t prevents cow or people to take water from the river. Frog lives in the river but cows or people are still taking and drinking water anyway and anyhow.             It is absolutely disappointing when a person move away from the main topic of discussion and bringing in irrelevent ideas which never ever promote any things to the country. That what I called cheap politic which always led to disunity. Stop that ideologies. I agree with Peter’s comment.

            The ICC decision against Bashir was not about Nuer and Dinka conflict. Bashir must face his own judegment without propaganda made by his officials or his supportors. I am not supporting tribal policis. I am encouraging ICC to follow up the investigation against Bashir’s arrest.

      The next step will be how and when to get the arabized Nubian govt (NIF)leader (Omar). Now, the ball is on the arabized Nubian govt (NiF) to comply with ICC or else.

      If the arabized Nubian govt (NIF) decides to trash the CPA as it did to prevouse Peace Agreements, GoSS will not only declare the independence for South Sudan, but wage dirty ugly war without POWs from its side at the same time.

        Count down to one head of the state! Kim,Good Comment you have made. However, the Bashir’s days to be all life presdent are numbered to count down due to ICC coming decision. we are all confident that Basir’s arrest warrant will not trash shower the CPA, as he or his party(NCP) thinks. He must or will need to comply with ICC ruling or otherwise he will recieve his death certificate very soon.

        Is ICC judges decision on Pres. Bashir wondering us, we the Sudanese people? No at all, there is no something new about and agianst Pres. Bashir. He is an innocent killer,greedy, and dictator agianst his own people.Because I am an active citizen like the rest of you, I do think that ICC’S decision against Pres. Bashir is his own personal mis-conduct. I mean whatever the arrest warrant will be or might be, pres. Bashir, his chief of Staff and Minister of Defense bring the arrest warraant to Pres. Bashir. In another words, it is their personal and decision misconduct whether as a party or as an individual. Pres Bashir now is his time to deal with his an aggressive past or present behaviors. He deserve an arrest warrant and he must pay the price for it.

        One last point: If Bashir or his party(NCP) think that using cheap destructive weapon such as ICC’s decision to make CPA less attractive, then their partner(SPLM) has very many options on the table: One of the option might be for bashir’s party to make CPA very useful and attractive based on its principles and if not they will be kick out to the Egyptain’s Border-meaning that if Bashir’s party believe war is the only solution to every problem in Sudan. Second option should be for the SPLM to work for its interests as usual if Bashir’s party acting up as if like a chicken whose its head has been cut off! How simple is that?

    Thank Louis Moreno-Ocampo and all justice and equality seekers all over the world for brining hopes to our people and letting us feeling happy which nearly diminish from our hearts.
    Surely one day the justice will take over and as Darfurians we are sure that The Judges of the International Criminal Court will agree to issue an arrest warrant for Sudanese president Omer Al-Bashir because he made unhidden crimes which assist the persecutor to gather enough information about his atrocities including his own words. He is the one who said the western countries media presenters and news reporters are exaggerating in the dead figure and his stupid ness pushed him to say only 11.000 were been killed not 300.000 as reported by western media. What stupid man god.

    When the ICC decision come out the New Sudan will start and I am sure every single marginalised person in Sudan will celebrate the end of the nightmare.

    The ICC definitely will issue the arrest warrant against Al-bashir but the support of the international community, Sudanese veterans and marginalised people will remain vital by all means to put an end to this tyranny.

    We as Sudanese we have to stand up gently to rule the country and let it running again and guarantee better life for our peoples.

    The issuance of arrest warrant against Al-Bashir will remain one of the most crucial days for Darfur people, our brothers in Southern Sudan, activists and all freedom, peace and justice seekers in the entire world.

    Our happiness will complete when we see Mr Al-basher behind the bar and Silver Kirr ruling the New Sudan and all marginalized people participate equally not by colour of their skin or eyes but by the content of their mind.

    Too many peoples all over the world are worried about the consequences of the arrest warrant against Al-Bashir and many Jalabas campaign for this purpose but we are here to say it clearly we knew you very well; you are the sons and daughters of MK Nimr who escape the country when just the fight begun.

If the warrant is going to be issue in one week time against Bashir, that is the end of the CPA and and SPlM/A as well.         Good News! Finally time has come for the most senior CRIMINAL to be indicted by The Hague based court. No way out but he must comply. Bashir is still held responsible for the lives of thousands lost in Darfur, of recent, and not forgetting millions Southern Sudanese who in most cases were murder in cold blood must face the course of "JUSTICE."

        Lets clearly define our positions as Southerners in general and SPLM/A in particular to stand firm and rally behind our young southern based government so that the impacts of the ICC Indictment may not affect us. The international community knows what it is doing in the whole issue but why do we waste our times and efforts as southerneers backing in support of a gang? These divisions and arguements are meaningless and nothing so far we will benefit from it. He face really looks very clearly.... the MAN is soon going to hell. He’ll die there just like the former Yugoslavian President.

        If I may ask you, what is so special with Bashir being indicted by the ICC that will jeopardized the CPA when he actually murdered million of Southerners and Durfurians. to be frank were you happy when our people in the oil rich region of Bentiu were killed and displaced by Bashir soldiers so that they remain sole occupant of that area to extract South Sudan oil as they like.

        CPA doesnot belong to Omer Al Bashir or anybody else as it was stated clearly by our late hero Dr.John Garang. never worry CPA after Bashir will be just fine.

My friend, if your mind is not really functioning properly, then you better shot your mouth for you don’t know the fate that the Southerners people have between the Khartoum Government.

      Such kind of people like you are the people who can be deceived and proselytized by the Arabs people because of the shallow and thick minded they have without reasoning capacity. It doesn’t sound good to said that SPLM/SPLA will end?. What if for example, the SPLM/SPLA end like the way you said it, what benefit are you going to get? Did you like going to Arabs people to be slave. If you like to be slave, then not everybody needs to go to the Arabs like the way you want to. My friend if you go to school, then you are dissipating your time for nothing because in this way you can not totally help Nuer which is your tribe nor other tribes apart from Nuer. Your mind is really exhausted completely and it doesn’t even needs a doctor to check it up. It is completely damage. Don’t you know that SPLM/SPLA was formed without Bashir’s recommandation? Which means without CPA, SPLM/SPLA will stand with anything that the Khartoum Government is going to says either by war or by dialogue.

      Please dear, if you are supporting Omar Bashir, then you better go to Khartoum and join your friend Omar Bashir, otherwise you are nothing to us as Southerners. Look here Mr Nuer, how many years did SPLM/SPLA was been fighting without CPA? One thing you have to know is that SPLM/SPLA is not a weak party like other parties that I know in Southern Sudan. It is a party that can overcome all atrocities going on in Sudan as a whole. I vehemently believe that going of Omar Bashir to jail will bring prosperty to the whole Sudan. If you think that the arrestment of Omar Bashir by ICC will cause a war to Southern Sudan, then you better go to aboard or if you are in aboard already, then you better stay where ever you are if you fear of war.

      Finally, CPA was not in hand of Bashir neither Salva Kiir, but in hand of International Communities.       Nuer I do believe you have a wrong dream:" If the arrest warrant issue in one week against Bashir, then that’s is the end of the CPA and the SPLM/A?" as you said it. That is very wrong dead ended dream. Because you can not prove it, it is just your personal ideology. Mr. Nuer you need to undesatnd between major facts and your personal issues addicted. Why do you used very abusive language always against your own fellow citizens? Why are you acting up as if you were born on Janaury 9, 2005 (The year of the CPA). Because you seemed like you are outdated for the past events, war, hunger and diseases that were killing our innocent people. You are behaving like you don’t know the different between the past and the present! I think you are historical outdated not updated.

      Mr. Nuer, Two things you need to remember:

      First, SPLM/A is not a Dinka Movement as you said it. look at you,now I can prove it you are historical outdated and you are tribalist as your behaviors and abusing language showed you that you are a betrayalist and self-denier. If that is the way you look at the SPLM/A, then why are you bothering yourself to believe in an Independence South Sudan?
      Mr. Nuer, do you know what are the SPLM/A’s objectives and goals toward Sudan as a whole country? Do you know how many wars the SPLM/A has fought at the same time during the 1980s, 1990s to April of 2004?-Because the point I am making here is to aware you that SPLM/A is not afraid to protects the CPA, its citizens and the properties of the innocent people against the warlords. Sooooo If you don’t know all these time events, then you don’t know what are you talking about in this website. I know now what is your personal ideology: your ideology is "Brother against me attitudes". This ideology has no room in today’s Sudanese coming up generation.

      Second,CPA will not and never be dead ended as you said always. CPA is not going to end no matter who is going to an international jail—Whether Pres. Bashir,or Taha. Mr. Nuer, in order to make your point clear to the public: You need to understand what is CPA and what is included in the CPA? If you do not understand all these, then that’s why you are the trash-talker. Mr. Nuer, if the CPA’s days are numbered as you mentioned it, where would you go?

      Mr. Nuer,I think you are losing it. You are losing your thinking capacity on how you see things. You are losing self-control on how to make better judgement between facts and your personal ideals. You need to take some weeks off from wherever you are, then relax, take deep breath and look again and you will see the differences. your mouth is too much than yourself. You need to respect yourself before others respect you. you need to discuss the general topics without using your abusing language.     This is a great news to all those who have lost their loved ones under the tyrannical rule of this brutal dictator! Bashir does not only deserve being indicted by ICC but equally deserves ultimate penalty such as death sentence! Those who kill by sword die by sword!
    For those who are shaky that CPA will collapse, it is pretty clear that CPA is already dying! If there is no border demarcation, absolutely no prior preparations for 2011 referendum and the NIF bloody militarization of border areas like Abyei, then it doesn’t require you guys to be rocket scientist to infer that CPA is dead!
    If he officially declares the state of Emergency and attacks the South, then SPLA should make Unilateral Declaration of South Sudan as a sovereign state.

      Hey, remember, when you get rid of Bashir, there are other dangerous entities that will go with him for example the LRA leader who has been helped by Bashir to do as much atrocities against humanity in the Southern Sudan.

        Good News, but wait for few days to celebrate this great change in Sudan. there will be two options, either the NCP will declare state emergency and try to cancel the CPA or coup will take place after some Months to replace President a Bashir, power struggle will take place between NCP elites. any cancellation to CPA, South Sudan will declare independent!!! if Arabs choose to go back to the War than they will totally loose!! the best option for them is to calm down and implement the CPA fully, schedule for new election in July-2009 as per CPA than implement all the remaining Issues of CPA!! southerners should remain united and face the change together!!! the time for divide and rule is over from Arabs, they will not again divide the marginalize people!!! long live SPLM, Long live the Unity of south sudanese people, Long live the unity of Marginalize people!!!

    Good news to south, and west Sudan to end wars conflicts. Our belief is to make Sudan in general a best place to rest as "new Sudan".
    We all know the Sudan is surrounded by Arabs magnetic field that shields us from most of the world friends. So the issue of warrant arrest for president Omer Hassan Al-Bashir may be the part of the solutions to Sudan problem. Insecurity, human rights abuses and extreme poverty in the among localities of Sudan is cause by Omer al-Hassan Bashir reign. if you can think back comparing all the presidents who have rule Sudan.
    For President Omer to face hague will not have link with CPA. Why, he is not the only person to protect CPA implementation. I means without him CPA agreement can be implemented without dot by both parties.

    Good news. It matter not when AU and other Agencies are advocating for the deferral of the warrant of arrest. This is noise without impact. There is no point an egg wrestling with a stone, comeon. When it is officially unsealed and issued sooner than later, they will change the tone of their deferral demands. Before the arrest of Jesus for those who believe and read from the Bible, Peter took an oath not to deny Jesus this is because the arrest and trial of Jesus was a rumour and hearsay. But when the arrest metamorphosised into reality and executed wich led to our saviour’s crucifixion and death, Peter said " I do not know this man, neither am I one of his followers".
    AU leaders and NCP supporters will shunn the president as did Peter to Jesus. It is a matter of time when we shall see changes in their lips. In Africa we value life and will not insult a thief at his burial tomb because of the respect for the spirits of the dead. Even if he committed sodomy, he will receive decent burial and accompanied to his resting palace with no grudge. This is what AU is doing because it is just practising their ancestral rich heritage. As soon as Bashir is arrested,they will not bid him farewell to the gallows at the Hague nor will they refer to him again save for those who want to write history. CPA was negotiated while the fire was burning in Darfur and it did not fall within the mandate of CPA. That is why it has never been said that CPA is been violated in Darfur. Let us treat CPA and implement it within its agreed context. It is Bashir and Darfur that is the issue in the Hague.
    When you begin panicking about the collapse of CPA because of Bashir warrant of arrest, then we are making Bashir more stronger in spirit. Remove the drip from Bashir or the life support machine and let him die like any other human being whose brain has been medically declared dead. We should instead stand up and say CPA is not Bashir nor for him. It is ours as sudanese and let us defend it amidst the perceived threats. The indictment of Bashir is an indication of an end to tyranny in the Sudan and Africa.
    When I read the message from the President of America, I understood why they call themselve learned friends.
    For us who value humanity and life, we have nothing to lose than the 2 Million lives lost in the South and those estimated in Darfur. It is only unfortunate that Bashir is made to answer for the sins in Darfur and no justice for the lives lost in the South. With our faith, he may not escape trial by the Almighty since the crimes he committed in the South cannot be defined by any Parliament on earth or the Rome Statute. The Statute providing for Bashir crimes in the South and his subsequent trial after conviction and sentence to death from the Hague are to be found in the Almighty’s Statute.           Do you think being rude can add any meaningful conclusion to your argument? Why attacking this guy who always follows reasonable and realistic aspect of writing unlike other Northerners?           Who told you that people of the South, West, and East are united? If Southerners are not united, how can you talk about being united with other regions?

          Unilateral declaration of independance is not a magic wand that can automatically solve our own made calamaties. In fact, we have been independant for more than three years now and the results are obvious. Why are we cheating ourselves? are we really serious enough and understand what an independant state means?

          Arresting president Bashir is a fulfilment of justice but is never a solution to our lack of services, rampant corruption, incompetent government or lack of democracy. Instead, it’s a warning sign to our corrupted leaders and to some of us who are prepetuating hatred and faked tribal superiority that may lead to the replication of Rwanda genocide in Southern Sudan. Therefore, I don’t see any reason why most of us are euphoric. There is no reason for a comatous person to dance on the grave of his enemy...

You concur with Tayeb because he thinks after Bashir removal we have to do alot of work which presuppose that he should not be issued with the ICC warrant?             Secondly, the issue of Southern Sudan when it comes to rampant corruption resulting to lack of service delivery has nothing to do with the removal of Bashir. These are issues that post-war nations face. Bashir nor Tayeb shall never come to the South and fight against corruption for you and me.               Thank you for your comment. I personally like peaceful and intellectual dialogue which I believe is the only way out for the people of Southern Sudan.

              I’m not spreading mental incapacity as you have put it. Though your expression is a bit harsh,I do take it easy because it’s through tolarence we could build a better nation.

              What I’m trying to spread is how Southerners can capitalize on the reality facing president Bashir, in term of practical and tangible initiatives regarding their unity, good governance, social justice, and peaceful co-existance. I’m against emotional euphoria being shown by our people, because it’s transient, self-limiting, and adds nothing to our ultimate goal of obtaining strong and united Southern Sudan state.

              My concern is what benefits would South Sudan get when president Bashir is arrested? Would it compensates us our countrymen and women who were slaugtered in cold blood? Would it maintains and strengthens our blood- made CPA?

              I’m not against the application of justice. But sometimes, justice can be delayed for the betterment of all. What would happen if NCP decided not to remit us oil money? worse enough what if they decided to unilatrally abandon CPA? what would we do? declare a war and start a fresh after obtaining this valuable right of self-determination? What are the guarantees that the international community would be on our side this time? Are we united enough to fight another war after such a short interval? Don’t undertand that I’m afraid of war.I’ve been fighting on the differnent front lines as SPLA officer for eleven years, thus, I do clearly comprehand what a wide scale war means at this particular time.

              What I’m intersted in, is how could we make our way to 2011 and fight it once and for all. We should not be distracted by ICC or whatsoever, because this is what our enemy wants. After all where were this justice mechanisms when our people have been butchered for more than twenty one years?

Experts on Sudan have agreed with me that this is not the right time in Sudan to go ahead with the indictment. It will be the first time that a head of state is indictement. Therefore, this process was never try in the history of mankind that a head of state and the commander-in-chief was indicted. Therefore, all of you Dinkas have nothing or a successful histories to back up what all you are saying here.

    That’s why I’m saying that all of you Dinkas who responded to my comments are obssess with the SPLM/A just because it was founded by your uncle stupid Garang who is serving his 99 years sentence in the tomb now and decaying. I’m very sorry to say that soon or later, SPLM/A ideology of the New Sudan will diminish in southern Sudan and the Dinkas will be sorry starting with Nyadeng here and new husband Kuol Manyang.

    Going back to Bashir. He should have be invited long time ago when he was slaughtering so many southerners. But, I kind like understand that because the International Criminal Court was founded in 1998-2000 therefore, there was no justice in place. But, at time when southern Sudanese are enjoying the breath of peace, election coming up this year, and referendum in two years. Why would he be indicted now?

    Election is suppose to be coming up soon but assume that Bashir is indicted today, do you all think that there is going to be smooth election this year? No matter what the outcome will be Sudan or southern Sudan will not be stable country as a result of the indictment. T reseaon is that Bashir will resist and use all his power to punish those who stood with the ICC. All of you are dumb for sure because you do not see out the box.

    One other thing is that ICC do not have it own army to get Bashir. They depend on other countries to make the arrest. That process has been too slow allowing those indicted to punish the oppositions in the country for a long time causing suffering. My proposal would that if the ICC decided to go ahead with the indictment, they must go to Sudan within one week to get Bashir otherwise, they cannot just make a statement and stay there in Europe as Sudanese will be slaughtering each other.

    Declaring independence for southern Sudanese as a result will have both positive and negative effects. First, southern Sudanese would have to be ready for the populations that have been living in the north when they are expelled from the north. The north might even retaliate by going after those who are in Khartoum as result of declaring independence. What I’m saying is that we need to declare independence responsibily. All these fool Dinkas talking here are all living in America, Europe, Australia, or outside Sudan. You must think about some of our brothers, mother, fathers, and sisters who are still back here like me and living in Khartoum. There are alot of other reasons why the indictment is at the wrong time but I’m not going to speculate on all of them here.

    One good thing that I have noticed here is that, it become true that the saying that has been going around among the Nuer that ’one Nuer equal to ten Dinkas.’ It is true because I’m the only one going against about 2 dozen Dinkas. My three sentences make Dinkas to write almost a page in response to my word. I’m proud of who I’m. I’ll never stop down with the SPLM/A until it die in the heart of southern Sudan.

    I don’t think SPLM/A is interested in declaring independence in southern Sudan because that will be the end of the SPLM/A. When southern Sudan declare independence, where will the SPLM go as a party? Will it still operate in southern Sudan? I’ll be really sorry for the Dinka bor as their party die out. The best days of southern Sudanese are coming ahead of them when the SPLM die. I know this writing will piss so many Dinkas off. But, take it for the day. If you want to get me, come to Kampala since I moved out last week. I can’t live in southern Sudan where the SPLM is stealing people money like that guy who ran to London with 3 million dollars. I bid, if you go to Saudi Arabia and say that “I can trace my family tree to Mecca and Madina” the will not only discredit your claim, but the will hung you so that you can not live another day to claim your are one of them.

How could you claim claim that we the southerners descendants from apes species and you are not. You cannot have it both ways my friend. You either be a religious person who believes in a creation, and agree with the fundamental principle of any heavenly religion, Judaism, Christianity, and Islam. That is mighty God created all human beings, and such belief would discredit your claim about the Southerners origin; or be an evolutionist who believes in Darwin evolution theory through which he argues that the origin of all living organisms have descended from common assenter. If that is the case, then all human kinds would be traced to one point in the polygeny tree. Should you want to know something about the evolution theory, then I refer you to read “the origin of species” which written by Darwin and published in 1859.

        Speaking about arrest warrant, we the southerners have nothing to fear. However, in 1916 British Empire decided to invade them and forced them to be a part of recent Sudan. These are quick facts that I wanted to educate you about. Do you know who manipulated British to work on your behalf, and why? Are Egyptians, and for obvious reasons. Do you know that Egyptians are the ones who lobbied Arab countries to let Sudan Join Arab league. Because of their lobby, Sudan was able to join the league on January 19, 1956, under one condition that is to just implant the recommendations, nothing more. Do you know who rejected the idea of Sudan joining the Arab League? It is Saudi Arabia, the one you claim to trace your descendant to. Do you think they did not know that there are some people like you that are being name after them in Sudan? That is the question you got to answer it for yourself, my friend.

            General speaking, I did not attend to response to you argument because you did not answer my pervious talking points; at the same time you did not come up with any arguable point that I could argue with you about. Rather, you just keep insulting the southerners on the baseless grounds. If you do not know how to argue, then shut your mouth up. I thought you will answer my points.
