Egypt warns Sudan that Bashir not immune from ICC prosecution

November 15, 2008 (CAIRO) – The Egyptian government warned Sudan that its stance on the International Criminal Court (ICC) is “weak” and will not protect president Omer Hassan Al-Bashir from prosecution.

“I thoroughly examined the ICC Statute to look for something that could aid Sudan’s position. Even though Sudan is not a state party this will not prevent the ICC jurisdiction in these cases and dropping all immunities” the Egyptian State minister for Legal and parliamentary affairs Mufid Shihab said during a forum at the Saudi Embassy in Cairo.

The Egyptian official stressed that the only way out for Sudan and its president is to take “concrete and concise steps” and that there is no point of taking extreme positions on rejecting the ICC.

The ICC prosecutor Luis Moreno-Ocampo Ocampo announced in mid-July that he requested an arrest warrant for Al-Bashir on 10 counts of war crimes and genocide. In early October ICC judges have officially started reviewing the case in a process that could possibly drag on to next year.

The statements by Shihab mark a radical shift in Egypt’s position which has backed Sudan in position against the ICC.

The Egyptian minister, who is an international lawyer expert, has previously said in August that Khartoum is not bound by the ICC since it is not a member of the court and emphasized that Al-Bashir enjoys immunity as a head of state.

Shihab’s remarks come days after the Egyptian president Hosni Mubarak paid a surprise and brief visit to Khartoum where he held private talks with Al-Bashir believed to have mainly focused on the ICC row.

Cairo backed an Arab League resolution last July which described the ICC’s prosecutor position as “unbalanced”.

The Arab League’s 22 foreign ministers decided in a resolution adopted on Saturday to show “solidarity with the Republic of Sudan in the face of any schemes aimed at undermining its sovereignty, unity and stability and not to accept the unbalanced position of the Prosecutor of the International Criminal Court at the request contained in a case submitted to the ICC (pre-trial Chamber)”.

The Arab minister further said they adopt this position to emphasis on their rejection to any “attempts meaning to politicize the principles of international justice or to use it to erode State sovereignty, unity, security, stability and national symbols”.

The Arab League devised a plan containing a series of steps to help Sudan avoid Bashir’s prosecution which included conducting internal trials for Darfur war crimes suspects. Following its implementation the UN Security (UNSC) could be requested to suspend the ICC move by invoking Article 16 for a period of 12 months that can be renewed indefinitely.

But the Sudanese presidential adviser Mustafa Ismail was quoted by the daily Al-Hayat newspaper at the time as telling reporters in Cairo after meeting with Arab League Secretary general Amr Moussa “that there are some parts of the plan that need more discussions”.

Ismail also insisted that the Sudanese judiciary is capable of looking into the Darfur war crimes and noted the recent appointment of a special prosecutor for Darfur by Sudan’s justice minister.

Shihab downplayed the Arab efforts on the ICC issue describing them as “rhetorical and emotional”.

“This will not avert the disaster” the leading figure in Egypt ruling National Party cautioned.

The French-Libyan born counsel Dr. Hadi Shalluf commenting on Shihab statements said that Cairo position on ICC “are contradictory”.

“The Egyptians do not have a fixed legal opinion. One time they say the ICC has no jurisdiction and then later they say no they do” Shallluf told Sudan Tribune by phone from Paris.

"This is the nature of the Arab politics. Legal opinions are variable depending on political positions. Arab justice ministers are politicians They don’t understand in law. They are simply policemen" he added.

Sudan has not ratified the Rome Statute, but the UN Security Council (UNSC) triggered the provisions under the Statute that enables it to refer situations in non-State parties to the world court if it deems that it is a threat to international peace and security.

    Sudan went out and brought some MIG 29s aka "Fulcrum’s"..

    Considering they have signed peace pacts why would they go and buy weapons from USSR whom was told by USA not to sell Sudan weapons? Thus I get the feeling that supposing the ICC does win, the people of Sudan shall not win..

    What I am implying is that Sudan shall become like Afghanistan I.e. A proxy war between USA and USSR! In addition karma is really something as the USA gave weapons to Al Qaeda’s so called "mujahedeyn" now turned "terrorists" due to USA turning on them! Furthermore, USA’s Economy would not be able to handle a proxy war with USSR or China!

    Dar fur thus becomes a facade! Almost 7million have died in Congo compared to the meager 300 thousand, why do we not hear of them? I personally believe that France needs to calm down about getting involved as they got involved in Rwanda and WE ALL KNOW HOW THAT TURNED OUT!

    In conclusion egypt has NO say in the matter! It all depends on USSR, CHINA and USA! Any one whom thinks other wise is in denial. Finally, USSR are still annoyed at USA’s involvement in Georgia..

    Thus Dar fur is still Dar fur, the ICC is still the ICC and the way the TV shows me, Mr. El Bashier is still President of that country called Sudan!

      Omer Albashir is preparing for the second round of war in the South. He sees the death of Dr.Garang as weakness for the SPLA and all other anti-Jallaba forces in the Sudan. But any stupid mistake from Albashir this time it will mean not only the end of NIF/NCP rule, but the end of the entire Jallaba state in the Sudan as well. No matter how many jets you buy, the black people of the Sudanese are stronger and more determined than any other time before. Iam sure that the next Jallaba’s war will be fought not in the South or Darfur, but inKhartoun through Madni and Matama.

        Dear Freedom Fighter, with much respect.

        Omar Albashir or Jallaba already bound with the CPA with no lease intention to go for war in the South if it splits or stay as part of Sudan. Extreme comments like this will not help or rather it would not be here because millions will echo in even many angry extreme comments that never serve Sudan or rather each of (2) Sudan(s). This Web should have a commitment to serve Sudan through constructive negotiations. If we differ with NIF government; our angry voice should not exceed to destroy our peaceful co-existence until we see what is going to be.

      Nobody should listen to any Egyptian official anymore. They are traitors, cowards, an an embarrassment to the entire arab world. Look at what they did in Gaza with their Israeli war crininals in Gaza. I do not know where this barbaric world is headed!!!. The ICC should issue an arrest warrants aganist the following war criminals and then Al-Bashir will turn himself in if these were brought to the Hague first:

      All the SPLA commanders who fought around Southern Kordofan States cuz they killed alot of women from Daleng,Babanoosa, and Alleeri and Talodi during the mid and the end of the 1980s. President Hosni Mubarak,and all Israeli commanders who invaded Gaza and murdered 1300 woment and childern. Now where is the ICC? it’s nothing in reality but another zionist entity that is going to create another Somalia!!!!

      Sudanese official should not handver Al-bashir and they should not let a coward, bias, and another Gordodn Basha tell them what to do. Just remember what our brave ancesters did to Okambo’s grandfather, general Gordon Basha!

      A sovereign nation should not allow some European piece of shit to tell them what to do. Look at Iran, for six years the EU,Israel, and the US did not do nothing to it because of their brave dtermination and they have two nuclear warheads by now. Bravo, Iran.

  • Everyone know what this thug did to Sudan and Sudanese people. He would bow to tipup hid ass everday asking Alah for forgiveness but nothing is going to stop the ICC from prosecuting this menaic. I myself cann’t wait for that glorious day when this son of unknown man will sit in jail.

    • Well, we need not to complain about Bashir war plan but of who will be our next president. Guys mark my word our leader is joining Saddam soon. It is a planned game without u turn. We the U.S lost boys are not sleep in Persian Gulf and elsewhere.
