UN report incriminates Sudan army’s acts in South Kordofan, calls for ICC probe

July 18, 2011 (KHARTOUM) – Acts committed by the Sudan army and its allied militias during localized violence in South Kordofan State may amount to “war crimes and crimes against humanity”, a UN report has said, recommending a probe into the alleged atrocities by the International Criminal Court (ICC).

Violent clashes erupted on June 5 in Sudan’s oil-producing state of South Kordofan between north Sudan army known as the Sudanese Armed Forces (SAF) and forces of the Sudan People’s Liberation Army (SPLA)

According to a report prepared by the UN Mission in Sudan (UNMIS) on the human rights situation during South Kordofan violence, the fighting appears to have been triggered by SAF’s attempt to forcibly disarm SPLA members, in contrast with SAF’s claims that the fighting broke out after SPLA members raided a local police station and stole small arms.

The report accused both parties to the conflict of engaging in acts against civilians, but it singled out SAF’s conduct as “especially egregious,” saying that the army and its allied paramilitary forces “have targeted members and supporters of the SPLM/A, most of whom are Nubans and other dark skinned people.”

UNMIS report documented a wide-range of atrocities it said were committed, particularly by SAF, against civilians as well as UNMIS staff.

According to the report, these violations of national and international law include aerial bombardments, forced displacement, abductions; house-to-house searches; arbitrary arrests and detentions; targeted killings and summary executions.

It also details reports of mass graves; systematic destruction of dwellings and attacks on churches. The UN previously estimated that more than 70,000 have been displaced by South Kordofan fighting.

The report says that the violence has resulted in a significant loss of lives, highlighting thirty-seven individual incidents of extrajudicial killings or death resulting from attacks on civilians.

It further said that the mission had received credible reports that extrajudicial killings have targeted people in Southern Kordofan who are affiliated with the SPLA and SPLM, most of whom are Nuba people.

The report said that the acts it described may amount to war crimes and crimes against humanity under national and international laws.

A number of recommendations were made by the report, including that the UN Security Council “mandates the establishment of a commission of inquiry or other appropriate investigative authority, including the Prosecutor of the International Criminal Court, to conduct a comprehensive investigation into the violence in Southern Kordofan and violations of human rights and humanitarian laws and to identify the perpetrators or those who bear the greatest responsibility, with the view to bringing them to justice.”

If the report recommendation is adopted by the UNSC, it will be the second time that the ICC has been authorized to get involved in Sudan. The Hagie-based court has already issued arrest warrants for three Sudanese individuals, including president Al-Bashir and South Kordofan governor Ahmad Harun on account of the atrocities committed by government forces in the western region of Darfur.

    Delay of conviction and trial is a big enemy of justice. Why should’t talk about crimes that are been committed by non other than Dr Riek machar and Dr lam Akol at this very time?

    To punish the criminals in Sudan. than that is not only bashir but including those two gangster mention above.

    there is no difference between those two Drs mentions and bashir since they where implemanted the agenda of bashir to distroy our SPLA/M.

    You can see now days that the so called riek machar is so happy thinking that we forgot what he has done to our brother In bor dinka. but no worries he don’t know what we are cooking yet we know what to do in order to lat the criminals got a pay back to what he did.

      you must read the article before you write your comment.Dr.Riek and Dr.Lam did not make any crime they just carrect the dectetor leadership who confuse peopl he alway say we fight to change the Sudan Regim and said we fight for Southsudan. When Dr.Riek and Dr.Lam told him let us fight for southsudan only he refused that was the cause of defaction of Reik and Lam because their vision is SouthSudan only. without their vision there could be No southsudan independent now.

      If John Garang was alive, there could be No SouthSudan indepent because his vision was New Sudan, But the world politicians knew his wrong vision that is why they lost in SKY even now No body will let you know the killer even president Kill because his visions was Southsudan like Dr.Riek and Lam. The killer of John Garang is not Arab.
      I know why you always claim that Riek made crim it was because LOU Nuer fought with Dinka Bor those people are not soldiers but Lou youth, why Bor youth did not fight with them the just only blaimed Riek for with their cowardnes. No body will kill Riek because it was civilians war just cry with your heart till you die. In Uganda Bor used to said that they were kill by Nuer that is why we want to go America during the interview of reseltelment, they used to failed when those of IOM heard that , the IOM used to tell them why you did not fight back while they are civillains like you.

    Let’s be vigililant to know types of crime that constitute warrant of arrest not just because you do not like me or another but type and the weight of the offence is what matters. ICC has no market in the South Sudan at the moment but by the time leaders would refuse to leave sits, crimes that human Rights will refer to the ICC will be available,
    For Bashir and Haroun, there is nothin to change the situation unless the president is placked out by his own people and that will give the ICC the biggest chance to aprehend those it wants

    It is easy say than done, since you issue arrest warant for numbered of people, how many have you arrested???, Bashir will still leave years as president of North sudan and will continue to kill innocent people what is you move towards?? and you are still issuing more and more who will again kill many, Are you encouraging them to kill???

    People are tired of you warning of arrest.

      For those of you who don’t understand how the ICC works, it does not have a police force so cannot arrest those who it has issued arresy warrants for. This has to be done by the countries who have signed up to the ICC.

      Also the Icc cannot investigate anything that happened before it was established that is before 2002.

      Maybe you should google ICC and find out how the system works?
