Qatar’s former justice minister calls on Bashir to accept ICC trial in Sudan

January 2, 2011 (KHARTOUM) – The former Qatari justice minister Mohammad Najib al-Nauimi called on the Sudanese president Omer Hassan Al-Bashir to accept being tried by the International Criminal Court (ICC) in Khartoum.

In an interview with the Saudi-based ‘Huwa wu Hiya’ magazine published on Thursday, al-Nauimi warned that Bashir could face the same fate of the late Iraqi leader Saddam Hussein.

Al-Nauimi, who was on Hussein’s defense team, called on the Sudanese leader to invite ICC representatives to visit Khartoum and investigate for themselves the allegations leveled against him and conduct the trial there.

“If the court [ICC] refuses then this will be a slap to the parties standing behind the calls inciting to overthrow him [Bashir]” he said.

The Qatari lawyer said that the United States after being assured of defeat in Iraq ruled out military intervention to oust Bashir and instead is using the ICC to remove him and bringing him to an “unfair” trial.

The U.S. is not a member of the ICC but in recent years have warmed up to it and indicated it could join in the future.

If the Sudanese president rejects the proposal he may end up being sentenced to death like Saddam in light of the charges against him, he added.

The Hague tribunal does not impose the death penalty on suspects who are convicted and life sentence is the maximum penalty allowed under the ICC Statute.

In 2008 al-Nauimi offered to represent Bashir before ICC after its chief prosecutor presented the case to the judges.

The ICC indicted Bashir in March 2009 for alleged war crimes and crimes against humanity, and in July 2010 on charges of genocide, relating to atrocities committed by Khartoum’s forces in Darfur.

The warrant has places restrictions on his travel and forced him to shun several regional and international events.

Arab and African states have rallied behind Bashir and called on the UN Security Council (UNSC) to invoke Article 16 of the court’s Statute to defer the warrant for a minimum of 12 months that can be extended indefinitely.

    The criminal must be hung. He doesn`t deserve to live since he killed over 300,000 Darfuris and millions of Southern Sudanese. Go to hell Bashiir with your thugs of National Criminal Party!

    People like Al bashir they dont know what gonna be happen in the future untill the see rope put around his neck like his cousin saddam husien.

    This is something obvious that, Omar al Bashir have nowhere to hide himself on earth. There is no doubt Omar al Bashir will put in Court by all mean.

      That Lawyer is a good observer. A good analylst. The fate of President Bashir is in question. I do have the same view and i did comment on other relevant article that Bashir believe on the ability of white blood cell to resist the virus he acquired for himself.

      The matter will be worst after the South Sudan seceded. South Sudan will provide evidences and the number of prisoners of war released to the North (NCP)and the South will ask for their POWS where they were kept and if not then it will add to genocide and war crime he committed.

      The recent bombing of South Sudan that resulted to lost of Human and animals lives will be also an other evidences plus Abyei issue. Bashir will be in problems. Other problems are words he spoke about with regards to imposition of Sharia Law in Sudan and many others.

      These African leaders who stood behind Bashir to "called on the UN Security Council (UNSC) to invoke Article 16 of the court’s Statute to defer the warrant for a minimum of 12 months that can be extended indefinitely" will retreat and accept the oppinion of the international community.

      For Bashir to live longer and be respected he should accept the summon of the ICC.

    Where was this Qatar lawyer who is now telling Bashir to report himself to ICC? This good for nothing lawyer is asking Bashir now because South Sudan is going to break away and that has nothing with what he did to Sudanese people in Darfur. ICC did not ask Bashir to be tried yesterday or last week and the Qatarian’s lawyer was not away from the planet earth which everybody was talking about crimes committed against humanity but instead, he was silent because the crime was committed on African tribes of Sudan. So shut up and leave Bashir alone.

    Bravo. Thank you for summing up the above comments. You got it brother. Bashir’s world is getting smaller and smaller. One of the things that Al-Bashir does not see and believe in is that his life is dependent on peaceful implementation of CPA, other signed political agreements and finding peaceful resolution to Darfur conflict without using delay tactics and intransigence. Following the old footsteps of the previous regimes in Khartoum that kept Sudan at war with itself for over 50 years is not the right approach.

    Al-Bashir is given enough time to learn how to listen to the voice of freedom and human dignity, implementing or honoring signed agreements and democratic transformation. But misused those opportunities. The regime does not believe in recognition of the changing dynamics. The late Dr. John Garang has reminded them that "Sudan will never be the same." This statement to Khartoum and its northern supporters sounds like "lick your elbow."

    Now the choice is theirs: to accept the reality of the current political situation; accept the outcome of the referendum; reasonably resolve all the pending issues regarding the post-referendum arrangements, resolve the Darfur issue and accept the call of ICC. This is how his fate will be completely different from the fate of Saddam Hussein, Charles Taylor, etc .

    He might still be remembered as a good listener, although late, to the voices of freedom and the rule of law. He will still be remembered by regional bodies and international community for having listened to the voices of democratic change that no any previous presidents have done in the history of Sudan. Al-Bashir will still be remembered by Southern Sudanese for recognizing their freedom and God’s given rights and human dignity in particular.

    He will still be remembered by the Arab world and international community because he has done a lot to change the economic face of the thri-cities using Southern Sudan oil money. The economic life of Northern Sudan has significantly improved although majority remained poor. The whole world expects Northern Sudan, after South Sudan’s secession, to remain economically stable, safe from terrorism and other violent-related activities and peaceful with all its neighbors.
