Khartoum and Juba sign non-aggression pact

February 10, 2012 (KHARTOUM) – The governments of Sudan and South Sudan have signed a non-aggression treaty in the Ethiopian capital that is hoped to de-escalate growing tensions between the neighbouring states.

The chairman of the African Union High Level Implementation Panel (AUHIP) Thabo Mbeki said that the accord also provides for a monitoring mechanism that would look into any allegations of violations by either side.

"In the event that there are complaints or allegations from either side... then they should be appointed to the joint mechanism," Mbeki told reporters according to Agence France Presse (AFP).

The deal was signed by the head of South Sudan’s intelligence bureau, Thomas Douth, and Sudan’s director of National Intelligence and Security Services (NISS) Mohammed Atta.

In recent weeks the leaders in Khartoum and Juba have exchanged warnings of possible outbreak of war particularly as the long standing dispute over oil showed no sign of easing.

Last month, South Sudan suspended its oil production in retaliation to a decision by Khartoum to seize part of its crude exported through the north’s pipelines to satisfy what it claims to be financial arrears.

On top of that, the two countries accuse each other of supporting rebel groups fighting their respective governments.

In particular Khartoum lodged complaints with the United Nations Security Council (UNSC) detailing support it claims Juba gives to the Sudan People’s Liberation Movement North (SPLM-N) fighting the Sudanese army in the border states of Blue Nile and South Kordofan.

There have been several reports of aerial bombardments by Sudan Armed Forces (SAF) inside the borders of South Sudan in the last few months.

According to the pact, the two sides agreed to "respect for each other’s sovereignty and territorial integrity" and to "refrain from launching any attack, including bombardment".

Mbeki urged both sides to ensure Friday’s peace deal is adhered to.

"We are very serious... it is the responsibility of both sides to act now," he said.

It remains to be seen whether the agreement will produce any change on the ground or tone down rhetoric from officials in the two countries.

Since its inception in October 2009, the AUHIP has worked tirelessly to help Khartoum and Juba sort out their post-secession contentious issues such as oil, borders, Abyei, national debt and citizenship.

But so far little progress has been made on resolving these items. Last June, the Sudanese President Omer Hassan al-Bashir even scrapped an AUHIP brokered framework agreement his assistant signed relating to the conflict in South Kordofan.

Furthermore, another accord on Abyei crafted by Mbeki’s panel faced difficulties in implementation after Khartoum later attached conditions to fully withdrawing its troops from the disputed region.

In New York, the United Nations Secretary General Ban Ki-moon warned Friday that tensions between the two nations could escalate if outstanding issues are not resolved, urging peace and reaching agreements on all issues.

"The moment has come for the leaders of both countries to make the necessary compromises... that will guarantee a peaceful and prosperous future for both nations," he said in a statement.

        As long as our Oil doesn’t flow through Port Sudan anymore, and borders are demarcated together with a solution to the Abyei Issue – the north can be assured that none in the whole South Sudan is interested in any piece of their arid desert. They go to the Arab League and we go to the East African Community when we are ready for that. That is how we will part routes.

          I agree with you that we don’t want to c south oil exported through port Sudan just to diffuse any future complaining from u guys. Our arid desert alone is more than enough for us and it is full of riches you don’t know about, from the biggest ground water aquifer in the world, to under explored oil and gas to gold to our ancestors history and so on ...., this is just our arid desert !!!

The oil of South Sudan WILL flow through Sudan. An agreement will be reached, and peace will prevail.The poor, needy & vulnerable Will have hopes of living..c

    how did you sign the MOU 0f agression while SAF are still in ABYEI ?THIS AGREEMENT WILL NOT MARCH IF SAF DIDNT WITHDRAW FROM ABYEI.invading abyei by force is the great agression which can be tolerated.

      though we reach an agreement to use the facilities of khartoum,which pipeline are we going to use?are they going to dig another pipeline without the secret pipeline branches that will divert our oil to al obeid and to khartoum? to avoid conflict, let khartoum sealed there pipeline and we continue constructing ours.

    Any treaty can just be a scrapt of paper. This paper can be dissolved in water and drifted out. Many agreement were sign but dishonoured. Fashoda agreement was signed by Dr. Riek and Dr. Lam Akol but it was not respected by NCP. this pact was neither sign in Bible nor Quran. It will not take long before war break out.

      You don’t need to go back that far by mentioning Dr. Riak/ Lam agreement, just count on fresh agreement being signed by SPLA/M north and NCP in Addis Ababa few months ago and see what happen is gone like other . Do you know where is problems come from? Wasn’t Al -basher as we all thought but his uncle Alteib Mustafa is the one behind these policies

    Invading of Abyei is a violation and is a clear WAR!..” Bashir is a Vampire” placed to promote Arabs strategy in to Africa. South Sudan would admit signing of the non-aggression treaty in hope to stop growing tensions and seek the (SAF) withdrawal from Abyei right immediately. If not, chairman of (AUHIP) Mbeki cannot provide monitoring mechanism that would look into allegations of violations.

    Please let’s be optimistic and hope this pact to last not for along time but forever. The two countries have lost much because of the unjustified wars.So, all of us must be advocates of peace for the sake of the welfare of the peoples.
    I really confused why can’t we be good neighbors? the two of us wouldn’t have chosen secession unless it leads to peace.

    "The NCP are being weakened day by day. They knew they don’t have acceptance in the north. The viability of the northern nation is in question, as is the survival of Sudan’s ruling (NCP). What they term fighting may be strategic posturing as final deals over the territory between north and south. If not, Arabs ’ll fail when they fight the South Sudanese. Bashir ’ll obviously end up being arrested.

    Do not be fool by this so-called non-aggression treaty. Khartoum has track records of dishonoring anything they signed. This is a tactical move to cover the “Plan B” they recently uttered of pursuing to destabilize South Sudan. I trust that the ROSS leadership isn’t going to be blind this treaty. Stick to your guns and never concede even a drop of oil.
